Freelance Worker Protections Survey
Acting on the recommendation of the city's Workplace Advisory Committee (WAC), the Minneapolis City Council recently passed an ordinance to prevent wage theft of employees by their employers for work performed in the City. The WAC also recommended extending these protections to freelance workers (independent contractors) as well, and a first draft of a Freelance Worker Protections ordinance was recently posted here: https://lims.minneapolismn.gov/File/2019-00699.

We know from the experiences of freelancers that you, too, can have difficulty getting paid for your work, and that this type of work arrangement is growing. We need to make sure that everyone gets paid for the work they do, regardless of their exact employment setup.

Contract Value & Duration
A key component of the draft Freelance Worker Protections ordinance in Minneapolis is the threshold for determining which contracts would be covered by the ordinance: both the value of the contract, and over what duration of time. The initial posted draft covers contracts for work valued at $800 or more and performed over a 120 day span.

Contract Components
The initial posted draft of the Freelance Worker Protections ordinance would require that written contracts include at least the following information:
(1) The name and address of both the commercial hiring party and the freelance worker;
(2) An itemization of all services provided by the freelance worker;
(3) The compensation for the services, including the rate or rates and method of compensation; and
(4) The date on which the commercial hiring party must pay the agreed upon compensation or the mechanism by which the date will be determined.  
What other information or components of a freelance contract should an ordinance require?
Contract Disputes
It is a goal of the authors of the Freelance Worker Protections ordinance that it clarifies work agreements and helps to mitigate and minimize disputes. For example, the first draft includes a clause that bars hiring parties from demanding that a freelancer agree to lower compensation in order to be paid on time. It would allow hiring parties to withhold payment if the freelance worker has not completed the services contracted for, unless the failure to complete was caused by the hiring party’s failure to cooperate with the freelance worker in good faith.
