https://www.edfundah.org/golf-tournament/#waiver GOLF TOURNAMENT ACKNOWLEDGMENT, WAIVER AND RELEASE AGREEMENT In consideration of being allowed to participate in the “Thanks For Giving Golf Tournament” organized by the Education of Anaheim Hills, Inc. (“EFAH”), to be held on November 13, 2021, and any and all related events and activities (collectively referred to as the “EVENT”), I, the undersigned participant, hereby acknowledge and agree as follows: 1. I acknowledge and fully understand that my participation in the EVENT may involve the risk of injury, including the possibility of serious injury or death, not only from my own actions, but also from the action or inaction of others, the condition of the premises, or the nature of the activity itself. I knowingly agree to assume all such risks, known and unknown, and assume full responsibility for my participation. 2. I agree to conduct myself during the EVENT with all due regard for my own safety and the safety of all participants, observers and bystanders. I agree to comply with the directions of all EVENT organizers, and I agree to immediately notify EVENT organizers if I observe any unsafe condition or behavior during the EVENT. 3. I understand that the State of California is currently subject to various restrictions and requirements due to the COVID-19 pandemic. I recognize and agree to abide by all such restrictions and requirements. I also fully understand that there are dangers, inherent and otherwise, by participating in the Event during the COVID-19 pandemic, and further understand that my participation may expose me to the risk of illness, personal injury or death and/or causing me to acquire COVID-19 and transmission to others, such as my family. I hereby acknowledge that I am participating of my own free will in the Event and agree to assume the full risk of any injuries and/or damages and/or losses of any kind, regardless of severity and including death, that may occur in connection with my participation. 4. For myself, and on behalf of all of my heirs, assigns, executors, personal representatives and next of kin, I hereby waive and forever release the officers, directors, agents, volunteers, sponsors, and organizers of the EVENT from and against any and all liabilities, claims, expenses or causes of action of any kind or nature whatsoever, arising out of or relating to my participation in the Event. This release and waiver extends to all claims of every kind or nature whatsoever, foreseen or unforeseen, known or unknown. 5. I recognize that EFAH has the right to record the event through video and still photography of any and all participants. I hereby grant permission that such photography and videography of me may be used for event publicity, public information, or any other promotional use that falls within EFAH’s purposes and activities. I expressly waive any right to compensation arising from or related to the use of the images and recordings by EFAH taken of me. Golf Cart Consent and Liability Waiver: In consideration of the rental by the Black Gold Golf Club golf carts at the Event, I agree to return the golf cart immediately following the completion of play in as good condition as received, with normal wear being excepted. I represent that I am familiar with the operation and use of said golf carts and that I have read the instructions appearing on the cart and that I can operate and control the same in accordance with said instructions. I agree to pay for any damages that are sustained by said carts, facilities or grounds while the carts are in my possession. I understand that the sport of golf and the operation of the golf cart contain inherent risks including, but not limited to, the risk of property damage, personal injury and/or death. I voluntarily assume responsibility for all these risks. I agree that Black Gold Golf Club/Kemper Sports/City of Yorba Linda, its owners, officers, staffers, and affiliates, as well as the Education Foundation of Anaheim Hills, Inc., including its officers, directors, agents and representatives, shall not be liable for any personal/bodily injury or damages; or for any loss, damage or destruction of personal property. I voluntarily and expressly waive any claim of liability and agree not to sue for any loss to person or property. I understand this waiver is intended to be a complete release of responsibility for personal injuries or property damage and I recognize that I am waiving legal rights by signing it. I further agree to abide the following rules pertaining to the use of golf carts: 1. Drive and park cart on level areas at all times. Speed of this cart is controlled by a foot throttle (similar to an automobile). 2. No more than two persons and two golf bags may be allowed on a cart at any time. 3. All drivers of the carts must be at least 18 years of age with valid driver's license. No minors shall be permitted to operate the cart at any time. 4. Follow route signs posted on the course while keeping both feet and arms inside cart while it is in motion. 5. Be sure that you are sitting down and in full control of cart and have checked the directional switch to see that it is in the proper position to take you in the desired direction before releasing the emergency brake or before touching the foot throttle. 6. Black Gold's Player Assistants are present on the courses to keep play moving in timely fashion and to be of assistance, their instructions must be followed. 7. The club course reserves the right to refuse the use of a cart to any person not following the above rules. 8. It is absolutely prohibited for individuals, groups, volunteers, vendors, sponsors or any other tournament related persons to bring alcoholic beverages onto Black Gold Golf Club property without the written consent of management. All persons failing to adhere to this policy will be subject to immediate removal without refund. By checking on the box indicating “Accepted and agreed,” I affirm that I have read the foregoing “Acknowledgement, Waiver and Release Agreement,” that I fully understand and agree to all of the terms set forth above, and voluntarily sign this agreement. If the participant is less than 18 years of age, I am agreeing to the terms hereof as the parent or legal guardian of said minor.
