Read and scroll down to accept the following agreement: IMPORTANT: THIS IS A LEGAL AGREEMENT THAT STATES TERMS AND CONDITIONS GOVERNING OR RELATING TO YOUR PARTICIPATION IN FALLS CHURCH KIWANIS LITTLE LEAGUE'S CHARITY FUNDRAISER HIT-A-THON AND HOME RUN DERBY ('Event'). BY ACCEPTING BELOW, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, THAT YOU UNDERSTAND ITS TERMS AND CONDITIONS, AND THAT YOU AGREE TO BE LEGALLY BOUND BY IT AND ITS TERMS AND CONDITIONS. 1. Approval. I (‘Participant’) in Event, hereby give my approval for Participant to participate in Event. 2. Capacity, Authority and Accuracy. I represent and warrant that I am at least eighteen (18) years of age or are the legal guardian of the participant if not 18 years of age and have full legal authority to complete this application, including full authority to make use of any credit or debit card to which registration fees will be charged, and I do hereby consent to the collection of personal information by FCKLL. I further represent and warrant and that all information provided in Participant's application is true, accurate, current, and complete, and understand that such application shall be invalid and void if I provide any false, inaccurate, untrue, or incomplete information. 3. Possibility of Injury. I acknowledge and understand that participation in the Event may result in serious injuries, and that protective equipment does not prevent all injuries, and do hereby waive, release, absolve, indemnify, and agree to hold harmless Little League Baseball, Incorporated (‘LLBI’), Falls Church Kiwanis Little League (‘FCKLL’), and the officers, coaches, organizers, volunteers, sponsors, supervisors, participants, and persons associated therewith, including those transporting Participant to and from the Event, from any claim arising out of any injury to Participant whether the result of negligence or any other cause. Further, I give authorization to obtain medical care for Participant through the emergency medical system in the event of a medical emergency. 4. Return. I agree to return upon request any equipment issued to Participant in as good condition as when received except normal wear and tear. 5. Conduct. I understand that exemplary behavior is required of all FCKLL participants, including spectators. I agree to respect and abide by, and to ensure that Participant respects and abides by, any code of conduct or other rules or regulations governing behavior as set forth by LLBI and/or FCKLL (as amended from time-to-time), and understand and agree that LLBI and/or FCKLL may take appropriate action, including suspension or exclusion, when deemed justified in its own discretion. 6. Photography and Video. I understand and acknowledge that Participant may be photographed or video recorded (including live video streaming) while engaged in the Activities and other FCKLL events, and hereby grant permission for Participant to be so photographed, or video recorded, and for such photographs to be used on the FCKLL web site, on the FCKLL photo gallery site, FCKLL social media sites, in the print and/or electronic versions of local newspapers, and/or in FCKLL printed materials. I further understand, acknowledge and agree that such permission may be withdrawn only in a writing received by FCKLL within fifteen (15) days of the date of this registration at the following address: FCKLL, P.O. Box 6612, Falls Church, VA 22040-6612. 7. Waiver. Failure by FCKLL and/or LLBI to insist on strict performance of any of the terms and conditions of this Agreement will not operate as a waiver of any subsequent default or failure of performance. No waiver of any right under this Agreement will be deemed to be either a waiver of any other right or provision or a wavier of that same right or provision at any other time. 8. No Warranty. I acknowledge and understand that FCKLL makes no warranty that its online registration services will be uninterrupted, secure or error free, and does not guarantee the accuracy or completeness of any information in, or provided in connection with, the FCKLL site. I also agree that FCKLL is not responsible for any errors or omissions, or for the results obtained from the use of such information, and that any material and/or data downloaded or otherwise obtained through the use of the FCKLL site is at my own discretion and risk and that I will be solely responsible for any damage to my own computer system or loss of data that results from the download of such material and/or data. 9. Severability. If any provision or portion thereof of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision or portion shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. *
