I will be participating in or observing an activity, Students vs Alumni Basketball Game located at Paul Quinn College on the following date: April 6, 2024.

GENERAL RELEASE

In exchange for and in consideration of the College permitting me to participate in the Activity, I release its trustees, officers, agents, employees, and students from any and all liability, actions, causes of action, negligence, debts, claims or demands of any kind and nature whatsoever (including attorneys’ fees and costs) by me or the College which may arise by or in connection with my conduct while participating in the Activity or being on the Campus.

I understand that if this activity involves physically and mentally strenuous activities that could result in injuries, including death, I willingly assume all risks associated with such participation. I hereby certify that I have no physical injury, disease or ailment that would prevent me from participating fully in activities related to the Activity. I understand that the College does not assume responsibility for any insurance covering any damage or injury to me and I assume full responsibility for providing such insurance.

I understand that there may damage or loss that may occur to my vehicle or its contents while it is parked on the Campus. I agree that the College cannot and does not assume responsibility for any such property damage to the vehicle, theft of the vehicle, or any part of the vehicle, or loss of personal articles from the vehicle and I accept full responsibility for any such loss or damage.

COVID 19 RELEASE

The novel coronavirus, COVID-19, has been declared a dangerous pandemic by the United States Center for Disease Control and Prevention (the “CDC). Evidence has shown that COVID19 can cause serious and potentially life-threatening illness and even death. The CDC has issued guidelines with respect to when people should wear masks in public settings, at events and gatherings, and anywhere they will be around other people and also with respect to practicing social distancing in such circumstances.

The College cannot prevent you becoming exposed to, contracting, or spreading COVID-19 while utilizing the College facilities or participating in an activity on its Campus. It is not possible to prevent against the presence of the disease. Therefore, if you choose to participate in an activity while on the College’s Campus, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. In addition, it is your sole responsibility to follow CDC guidelines; and the College assumes no responsibility in this regard.

ASSUMPTION OF RISK:

I have read and understood the above warning concerning COVID- 19. I hereby choose to accept the risk of contracting COVID-19 for myself in order use a College Facility or participate in an activity while on the College’s Campus, The use or participation is of such value to me that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 while on the College Campus. I also assume all responsibility for following any CDC Guidelines on these matters.

WAIVER OF LAWSUIT/LIABILITY:

I hereby release and waive my right to bring suit against Paul Quinn College its trustees, officers, agents, employees and students in connection with exposure, infection, and/or spread of COVID-19. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

ACKNOWLEDGMENT OF UNDERSTANDING

I have carefully read this release of liability, assumption of risks, and indemnity agreement, and fully understand its terms and provisions. I understand that I am giving up substantial rights, including the right to sue. I freely and knowingly assume the risk and waive my rights concerning liability as described above. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
