I (“Participant”) expressly understand and acknowledge that I am voluntarily and of my free will participating in a Fluid Movement, Inc. production (“Production”). I am exercising my free choice to participate voluntarily in rehearsals and performances. I acknowledge that participation in the Production will include activities involving physical movement or development, which may have certain risks and dangers and the potential for mild or even severe injuries. I choose to voluntarily participate at my own risks, accept full responsibility for my own welfare, and accept any and all risks anticipated or unanticipated, associated with my participation in the Production.

By this agreement and for good and valuable consideration, it is my intention to assume the risk of any damages or injuries that might occur to me as a result of my participation in the Production or my use of or presence at both the rehearsal and performance spaces and Fluid Movement Headquarters located at 403 North Paca Street, Baltimore, MD (“Facilities”). By this agreement, I release, discharge, absolve, hold harmless and indemnify Fluid Movement, Inc., the City of Baltimore, and Baltimore Aquatics. (“Releasees”) from any and all liability, and waive and relinquish any and all claims or causes of action against the Releasees for any loss, damage, personal injury, disability, death, medication, or any other type of expense, injury or property damage or loss arising in any way from participation in the Production or the use of or presence at the Facilities. This release shall also inure to the benefit of the officers, legal representatives, licensees, and assigns the Releasees.

I hereby acknowledge that: I am a legally competent adult and have the right to contract in my own name; I have completely read and understand this agreement and its terms; and that prior to signing below, I have had the opportunity to ask any questions I may have about this agreement, the Production, and the Facilities. This release shall be binding upon me and my heirs, legal
representatives, and assigns.

I grant to Fluid Movement, Inc. the absolute and irrevocable right and unrestricted permission concerning any photographs and video that are taken or may be taken of me or in which I may be included with others, to use, reuse, publish, and republish the photographs and video in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, and documentation without restriction as to alteration; and to use my name in connection with any use if he/she/they so chooses.

By this agreement I release and discharge Fluid Movement, Inc. from any and all claims and demands that may arise out of or in connection with the use of the photographs and video, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the officers, legal representatives, licensees, and assigns of Fluid Movement, as well as the person(s) who took the photographs and video.

I certify that: I am a legally competent adult and have the right to contract in my own name; I have read this document and fully understand its contents; and that this release shall be binding upon me and my heirs, legal representatives, and assigns.

COVID-19 is highly contagious, and my participation in this activity exposes me to a level of risk of contracting COVID-19.

It is my responsibility to comply with the guidelines of the City of Baltimore and the State of Maryland relating to COVID-19.

I voluntarily assume the risk that I may be exposed to or infected by COVID-19 by participating in this activity offered by Fluid Movement, and that such exposure or infection may result in personal injury, illness, permanent disability, and death.

I understand that the risk of becoming exposed to or infected by COVID-19 by participating in this activity may result from the actions, omissions, or negligence of myself and others, including, but not limited to, FM members, volunteers, Directors, and program participants and their families.

With full awareness and appreciation of the risks involved, I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself or my family (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my family may experience or incur in connection with my participation in this programming (“Claims”).

On my behalf, and on behalf of my family, estate, heirs, executors, administrators, assigns, and personal representatives, hereby release, covenant not to sue, discharge, and hold harmless Fluid Movement, its Directors, agents, and representatives, and any third-party, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind directly or indirectly arising out of or relating thereto.

I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Fluid Movement, its Directors, agents, and representatives, while participating in any activity while in, on, or around the premises and/or while using any facilities, materials, or amenities, whether a COVID-19 infection occurs before, during, or after participation in any FM program.
