CGRS announces the release of a new practice advisory, entitled “Restrictions on Employment Authorization for Asylum Seekers: Overview of USCIS’s June 26, 2020 Final Rule.”

On June 26, 2020, USCIS issued a devastating final rule restricting employment authorization documents (EADs) for numerous asylum seekers. This practice advisory provides an overview of the rule’s principal changes, namely: (1) an increase in the waiting period for an initial EAD to 365 days and the elimination of the “Asylum EAD Clock”; (2) the creation of expansive bars to initial and renewal EADs; (3) the termination of employment authorization upon an administratively final asylum denial; and (4) the newly discretionary nature of initial and renewal EADs. The advisory highlights preemptive steps advocates can take before the rule goes into effect on August 25, 2020 as well as other strategies for preserving their clients’ eligibility for employment authorization.
