Participant Release Form for Online Program: To be completed by parent/legal guardian if participant is a minor.

I am the parent or guardian of the "Participant" (Student) listed below. I give permission for Participant to participate in the online program “Partnerships in Literacy Through Dance and Creativity©" with Mark DeGarmo Dance (the “Program”) in Spring 2021.

In consideration of the participation by Participant in the Program, I hereby authorize Mark DeGarmo Dance and its representatives and employees to photograph, video, film, and/or interview Participant and to use Participant’s statements, image, voice, likeness and/or story in any format, including video, audio, photographic, digital, electronic, written materials or any other medium (the “Materials”). I also authorize Mark DeGarmo Dance to use the Materials for the purposes of educational, editorial, trade, advertising, promotional or any other purpose at its sole discretion and in any manner and media; to alter the same without restrictions; and to copyright the same.

I hereby waive and release Mark DeGarmo Dance and its board of directors, officers, employees, agents, affiliates, volunteers, legal representatives, and assigns (the “Released Parties”) from any and all claims arising or resulting from or in connection with the use of the Materials under this agreement, including any claims relating to copyright, rights of publicity or privacy, false light, or moral rights that I or Participant may have in the Materials and any claims or rights of compensation regarding the Materials and understand that all such recordings shall remain property of Mark DeGarmo Dance.

I also understand that participation in the Program has risks that may arise from Participant’s actions, inactions or negligence, or the actions, inaction or negligence of Mark DeGarmo Dance and other participants in the Program, or others present. These risks may arise or result from risks inherent in the Program, including injury due to space limitations, floor surfaces, not following directions, incorrect movement, and cyberbullying. By signing below, I assume any such risk of harm or injury which might occur as a result of or in connection with Participant’s participation in the Program and hereby waive and release the Released Parties from any and all liability, costs, damage, losses, expenses and attorney’s fees whether now existing or that may later accrue resulting or arising directly or indirectly from Participant’s participation in the Program, including any damages caused by negligence.

I understand that Participant must follow instructions, uphold all safety rules and directions, and the school’s code of conduct and our dance classroom’s guidelines for participation and behave responsibly so as to avoid any injuries to Participant or any other person. I confirm that Participant is in adequate physical condition to participate.

The release, waiver and authorization shall be binding upon me and my legal representatives. By signing, I am agreeing to the contents stated above. I am the parent or guardian of the Participant (Student) listed below and give permission for Participant to participate in the online program “Partnerships in Literacy Through Dance and Creativity©" with Mark DeGarmo Dance (the “Program”) in Spring 2021.
