PHOTO PRINT SALE VS LICENSING
In providing a photograph (digital file of) we are the Licensor and you are the Licensee.

WHAT IS IMAGE LICENSING?
"The licensing of an image (photograph) occurs when the creator/owner sells the intangible right to use the image to a customer for further commercial use, while retaining ownership of the image. Thus, the income arises not from the sale of a tangible print, but from Licensing the Use of the intangible property. Typical rights granted to customers include the right to publicly display, exhibit, publish, reproduce or to create another product". re: WA Dept Of Revenue 2020

LEGAL DOCUMENTATION
It is important that we retain documentation establishing the nature of the transaction to comply with Washington State Dept. of Revenue's Rules and Regulations. "The invoice, contract or other instrument of sale must clearly state the specific intangible rights that are being granted to the user of the photo. The fact that the invoice may have a line item for “licensing” or “rights of usage” fees is not, in and of itself, determination if the exact rights are not also described." re: WA Dept Of Revenue 2020

PRICING
Prices set with 3 things in mind. (1) time and difficulty in providing the best digital file for your requested use which may include research, digital scanning of negative/s, digital restoration and sizing for project, if the photograph is not already prepared; (2) use of and the financial benefit to you or your company (commercial uses vs non-profit or educational); And, (3) in-line with fair market value. We review what other private, commercial and public collections regionally currently charge and set prices accordingly.

QUOTE & LICENSING AGREEMENT
Price and Use is determined by the information provided here so please fill it out as completely as possible to expedite the process. If your use is agreeable, you will receive an Agreement Contract via the email address provided for proper Signature and an Invoice will be sent.

PAYMENT
Payment can be made online through PayPal or Venmo using Credit or Debit cards. Upon receipt of your Payment the Digital Image File/s will be made available to you for download in the size and format necessary for your project, usually via Dropbox unless other arrangements have been made.

TURN AROUND
If the Digital File/s is ready it is usually between 2-5 days. IF photo negative is not scanned, or editing not completed a longer time will be needed and you will be informed. Rush Orders for extra fee.

DIGITAL FILE SPECS
All digital files are provided in-house. Pixels and Resolutions are dependent on job requirements.
