The following waiver establishes the responsibilities and liabilities of Edge Cycles Cornwall Ltd and that of the client who undertakes a mountain biking excursion with them. In signing at the bottom of this document, I acknowledge that I have read, understood and accepted the following points:
1. I AM responsible for informing the venue staff BEFORE the ride of any existing illness, injury, or allergy that I have that might affect my ability to undertake the ride, or which might require treatment during the ride. Moreover, it is my responsibility to inform the venue staff of any help I may need.
2. Mountain biking activities, like other adventure sports, contain an element of risk. As such, I understand that there are risks associated with the activities I will be undertaking with Edge Cycles Cornwall LTD and I accept that it is neither desirable nor feasible to remove all risk from these activities and that this risk is an essential part of the experience and provides the challenge of outdoor activities. I acknowledge that the enjoyment of undertaking activities beyond the normal safety of home, work or country is in part the reason for my participation in this activity. I am aware that Edge Cycles Cornwall LTD and its employees will take all reasonable and practicable steps to manage these risks to an acceptable level. At any time during this activity I understand I am free to ask for information on the activity and make my own decision on my level of involvement. I accept personal responsibility for my own actions during this activity, which I undertake at my own risk. I also acknowledge that should I act contrary to, or outside of, the instructions and advice I have been given, I significantly increase my risk and in doing so will be personally responsible for any consequences. I am also responsible to ensure that my actions or inactions do not jeopardise the safety of others. I accept that Edge Cycles Cornwall LTD are NOT responsible or liable in the event of injury, loss or death resulting during the activity.
4 I understand that All activity sports involve an element of risk and that it is my own responsibility to ride with due care at all times. If in doubt I should WALK where I am not confident to ride. I understand that it is a condition of participating in Edge Cycles Cornwall LTD cycling activities that I will agree to wear an approved safety helmet at all times while riding. If I bring my own bike I am responsible for keeping it in good working order. Edge Cycles Cornwall LTD take no responsibility, except to the extent that is caused by the negligence of its employees, for any death or injury caused to or by myself, or for damage to or loss of property. I should keep valuables safely with me at all times. Signing this 'disclaimer' form prior to the ride signifies that I agree to abide by the authority of any employees, who represent the company. I understand that Edge Cycles Cornwall LTD reserve the right to terminate the participation of anyone who, in their opinion, is acting in a way that is likely to cause upset, danger or injury to themselves, employees, customers or others or cause damage to property. In these circumstances we will make no refunds and you will be liable for any costs incurred
5. I further agree that if I am injured or become ill during the activity, Edge Cycles Cornwall Ltd may, arrange or supply medical treatment, evacuation or any other emergency services on my behalf as they deem necessary or appropriate for my safety and well being.
6. I understand that the liability of Edge Cycles Cornwall Ltd to me in any circumstance is limited to the amount I have paid for the activity. I understand that Edge Cycles Cornwall LTD take no responsibility for the safety of clients' baggage and personal effects. I understand that I should be adequately insured against loss, theft or damage. Edge Cycles Cornwall LTD shall not be held liable for any damages caused by the total, or partial failure to carry out the contract if such failure is: a) attributable to the passenger; or b) unforeseeable or unavoidable and attributable to a third party unconnected with Edge Cycles Cornwall LTD or c) as a result of unusual or unforeseeable circumstances beyond our control such as strikes, war, civil or political unrest or government action or d) a result of an event that we with all due care could not foresee or forestall or e) due to the theft of bicycles or injury as a result of cycling on road or off-road and in particular injuries as a result of either inadequately maintained and serviced personal equipment or failure to wear the correct safety equipment, most notably a safety helmet.
7. Edge Cycles Cornwall LTD reserves the right to cancel or modify the activity or session for the safety of participants or where conditions make the session unfeasible in its advertised form. In such an occurrence, Edge Cycles Cornwall LTD will endeavor to provide safe and fun alternative activities to the group on that day. Where the cancellation or modification is the result of circumstances outside of Edge Cycles Cornwall LTD direct control (including, but not limited to, unseasonably bad weather, civil protests, an accident, or road closures or blockages), They will not provide any refund, but will offer a transfer of dates to another available session.
