Booking Form

By completing & submitting this booking form, the hirer or their agent is agreeing to the following terms & conditions.

Service Period
Pursuant to the responsibilities of hirer, Febulous Photobooth agrees to have a photobooth operational for a minimum of 80% during this period. Client understands that occasionally, operations may need to be interrupted for maintenance of the photo booth.

Travel, Hiring, Delivery and Service
Setup and removal of the photobooth are free of charge and occur outside of the booked rental period.
A photobooth attendant will remain with the photobooth for the duration of the booking time.

Free delivery is included within 30kms of Perth CBD and anything outside this radius is charged at $3.60 per km.

Access/Space Requirements
We require one chair and a clean flat surface of approximately 3m x 3m x 3m and one normal power outlet within 10 metres.
It will be the hirer’s responsibility to ensure their venue function coordinator or private function coordinator is made aware of these requirements and can accommodate them.

Safety precautions/booth rules:

* No food, drinks, cigarettes or e-cigarettes in the photo booth area.
* No drinks or food on the photo booth tables.
* No props to be removed from the photobooth area.
* Children under the age of 10 to be accompanied by an adult when selecting props.

Props
All our packages include a supply of a variety of props for our clients and their guests to use at their booked event. We reserve the right to withhold or remove all or certain props from use if the attendant considers they are being damaged, mistreated or continually removed from the photobooth area. Children under the age of 10 must be supervised by an adult when selecting props and when operating the photobooth.

Photo Releases
Hirer grants us permission to use images from the client’s event to promote our business, including but not limited to, use on our website, blog, social media and print marketing materials, unless the client requests otherwise, in writing, before the date of the event.

Febulous Photobooth will not use images which are deemed unsuitable or inappropriate on our website or for advertising and will not use any content that we consider may be personally damaging to any person(s).

Febulous Photobooth will not sell your personal details to any third party and will take all reasonable measures to ensure that your personal details remain confidential.

Failure to Complete
At all times care will be taken by Febulous Photobooth to ensure delivery of the booked package, however, should unforeseen equipment failure prevent this, during the normal course of events, liability will be limited to a total or partial refund of monies paid, dependant on our deliberation of the unique circumstances and/or the amount of the booking that was fulfilled successfully.

Febulous Photobooth cannot be held in any way liable if equipment or accessories failure or damage (including electrical, water or other liquid damage) is due to any negligence, an act or fault on the part of any venue or venue staff or is due to any negligence, act or fault on the part of any client or client guest or other person using the photobooth at your event/function, which negligence, act or fault, wilful or accidental in turn prevented the successful completion of the agreed to Febulous Photobooth service(s).

Parking
The hirer shall provide parking for Febulous Photobooth’s vehicle while at Client’s event.

Delays
Febulous Photobooth cannot be held responsible for unforeseen delays at the venue, which are out of our control.

Force Majeure
A Party will not be in breach of or in default under this Agreement on account of, and will not be liable to the other Party, for, any delay or failure to perform its obligations by reason of fire, earthquake, flood, explosion, strike, riot, war, terrorism, or similar event beyond that Party’s reasonable control (each a “Force Majeure Event”).

However, if a Force Majeure Event occurs, the affected Party shall, as soon as practicable:

(a) Notify the other Party of the Force Majeure Event and its impact on performance under this Agreement; and
(b) Use reasonable efforts to resolve any issues resulting from the Force Majeure Event and perform its obligations under this Agreement

Payments
A non-refundable reservation fee in the amount of $200 is required upon submitting the booking form. Until payment is received, the date cannot be confirmed. The remaining balance will be payable by the hirer or their agent at least 14 days before the booked date, unless otherwise agreed to in writing by both parties.

Short Bookings/Overtime Rates
Should the client, or their representative decide to extend the booked time during the event, the extended rates are as follows (payable at the beginning of the extended time, as a cash payment).

           -after the 2,3 4 hour package -  $150 per hour
           -after the 5 hour package -  $100 per hour

Date Changes & Cancellations
Any request for a date change must be made in writing at least thirty days in advance of the original date. Change is subject to photo booth availability. If there is no availability for the alternate date, the non-refundable reservation fee shall be forfeited, and event cancelled.

If event is cancelled for any reason by the hirer, the non-refundable reservation fee is forfeited.

If event is cancelled by Febulous Photobooth, all monies paid to date will be refunded in full.

If Febulous Photobooth has not received final payment for a booking at least 14 days before the booked date, Febulous Photobooth will deem that a cancellation on behalf of the hirer and all monies paid to date will be forfeited, unless both parties have made prior mutually agreed to arrangements in writing for a late payment.

Miscellaneous
The Febulous Photobooth operator may pause or terminate the use of the photobooth at any time during the event if they consider that the guests are behaving in a way that the operator(s) believes to be dangerous to themselves or any persons, or potentially damaging to the product.

The photobooth attendant reserves the right to exclude a person or persons from the photobooth if the attendant considers that person to be grossly intoxicated or behaving in an aggressive or abusive manner towards the photobooth attendant or behaving in a manner that the photobooth attendant considers may damage Febulous Photobooth property.

Damage to Provider’s Equipment
The hirer acknowledges that it shall be responsible for any damage or loss to the Provider’s Equipment caused by
(a) Any misuse of the Provider’s Equipment by client or its guests, or
(b) Any theft or disaster (including but not limited to fire, floor, or earthquake)
