MUST BE ACCEPTED, COMPLETED, AND ELECTRONICALLY SIGNED BY PARENT/GUARDIAN BY THE FIRST DAY OF YOUR STUDENT'S PROGRAM.

I am the lawful parent and/or guardian of the student listed below (“Student”). Student is a student of The Episcopal School of Dallas, Inc., and/or a participant in summer and school-year programs, activities, field trips, sports, athletics, events and/or affairs (a “Program”) of and/or sponsored by The Episcopal School of Dallas, Inc. (“ESD” or the “School”), whether on or off its property. Programs may involve physical activity, travel in vehicles and various types of equipment, such as playground equipment and athletic equipment, which can subject Student to risk of serious bodily injury or death. I hereby acknowledge such risks and certify that I have examined Program materials and made my own judgment concerning the suitability of each Program for Student. In consideration of Student being enrolled and permitted to attend a Program, and to the full extent allowed by law, I/we, on behalf of ourselves and Student, HEREBY AGREE TO WAIVE, RELEASE, INDEMNIFY, AND HOLD HARMLESS ESD, its Trustees, Administrators, Heads of Schools, Faculty, agents, employees, representatives, volunteers and invitees, together with all persons, including parents of students of the School assisting with any phase of any Program (collectively referred to as “Releasees”) (but not third-party vendors and service providers, such as paid certificated carriers), FROM ANY AND ALL CLAIMS, SUITS, LOSSES, DAMAGES, CAUSES OF ACTION OR OTHER LIABILITIES and all expenses of litigation and/or settlement/release (“Claims”) by reason of any accident or injury suffered by Student, which may arise in connection with the School, Programs, School trips, or School activities, WHETHER OR NOT CAUSED BY OR ALLEGED TO BE CAUSED BY THE NEGLIGENCE OF A RELEASEE ACTING IN THE SCOPE AND COURSE OF EMPLOYMENT. I/WE HEREBY STIPULATE, AND AGREE NOT TO CHALLENGE THE ENFORCEMENT OF SUCH STIPULATION in any proceeding, THAT THE SCHOOL’S LIABILITY in all matters related to the subject matter of this Agreement or the student’s affiliation with the School is LIMITED BY TEXAS LAW, including, but not limited to, Chapter 84 of the Texas Civil Practice and Remedies Code. I/WE FURTHER AGREE TO NOT BRING SUIT AGAINST ANY RELEASEE FOR ANY CLAIM ON BEHALF OF OURSELVES OR STUDENT. The undersigned hereby permits ESD to use images, photographs, film, videos, written extractions and voice recordings taken of Student, along with Student’s name, in conjunction with promotions, publications, posters, websites, or other communications to promote ESD and its programs as ESD so chooses from time to time. I acknowledge that a Program may be cancelled or altered by ESD with little or no notice for reasons outside ESD’s control, including, for example, due to government or other recommendations or requirements in response to a pandemic, and agree to waive any Claims I might have related to such cancellation or alteration.
 
I acknowledge and agree that I have read this Release and Waiver, and that I agree to the terms contained in it.
