In checking the box below I agree that I am or will be participating in the Yoga Classes, Health Programs or Workshops offered by Yoga Factory Pittsburgh during which I will receive information and instruction about yoga and health. These classes entail intensive physical activity (conducted in a heated room – approx. 105 degrees Fahrenheit) and exertion by me. I recognize that such physical activity and exertion may be difficult and strenuous and may cause or aggravate a physical injury or medical condition. I am fully aware of and accept the risks and hazards involved. I understand that it is my responsibility to consult with a physician prior to and regarding my participating in the Yoga Classes, Health Program or Workshops, and to receive prior approval to participate. I represent and warrant that I am physically fit and I have no medical condition or injury which would prevent my full participation in the Yoga Classes, Health Programs and Workshops. In consideration of being permitted to participate in the Yoga Classes, Health Programs or Workshops, I agree to assume all full responsibility for any risks, conditions, injuries or damages, known or unknown, which I might incur or aggravate as a result of my participating in the same. I understand that any digital projects, social media, or marketing campaigns that I may participate in while on the premises of Yoga Factory Pittsburgh shall become the property of Yoga Factory Pittsburgh and may be used for marketing and advertising purposes at the sole discretion of Yoga Factory Pittsburgh. I hereby grant to Yoga Factory Pittsburgh the right and license to use my name, image, likeness, voice and persona for the purpose of promoting, marketing and advertising Yoga Factory Pittsburgh to the public. In further consideration of being permitted to participate in the Yoga Classes, Health Programs or Workshops (the “Programs”), I knowingly, voluntarily and expressly waive any claim I may have or acquire against Yoga Factory Pittsburgh, or the landlord or any premises at which it may operate, for any injury, condition or damages that I may sustain as a result of entering or being on the premises or participating in the Programs. Unless I notify the school, in writing, within 14 days of this release, I further consent to the unrestricted use of any photographs or video taken of me or my child by or on behalf of Yoga Factory Pittsburgh. I understand that there is a no show/cancellation fee in place, and that if I do not cancel a reservation I may be charged a $10 no show fee. I understand that COVID-19 (including variations and mutations) is a highly communicable virus that can cause, among other conditions, severe respiratory illness, sometimes leading to death, in individuals who contract it. I will not attend in-studio, or any other in-person Activities conducted or organized by or through Yoga Factory Pittsburgh if I am exhibiting symptoms of COVID-19 (which can include fever, cough, shortness of breath or difficulty breathing, chills, repeated shaking with chills, muscle pain, headache, sore throat, new loss of taste or smell), or if I have been exposed to a third party who has exhibited COVID-19 symptoms in the 14 days preceding my participation in the Activities. I understand and expressly agree that my use of a Yoga Factory Pittsburgh Studio or participation in any other in-person Activities conducted or organized by or through Yoga Factory Pittsburgh involves the risk that I could contract COVID-19 notwithstanding the mitigation measures in place by Yoga Factory Pittsburgh. I understand that these risks are inherent to my use of the facilities or participation in such Activities and can range from mild symptoms to major illness, including death. I further understand and voluntarily accept full responsibility on my behalf for the risk of contracting COVID-19.I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue Yoga Factory Pittsburgh, or the Landlord of any premises at which it may operate, for any injury, condition, or death which arises, is caused by or is aggravated by reason of my participation in the Programs. I understand that it is my continuing responsibility to inform the instructor(s) at Yoga Factory Pittsburgh of any previous medical conditions, injuries or surgeries prior to my first class and at such other times as I acquire information as to the same. The tuition paid herewith and such registration fees paid hereafter are non-refundable, such refunds, if any, as are made shall be entirely within the discretion of Yoga Factory Pittsburgh. I understand that Yoga Factory Pittsburgh or any premises at which it may operate are not responsible for any lost or stolen personal, or otherwise, items that I own and bring to the studio. I knowingly, voluntarily and expressly waive any claim I may have or acquire against Yoga Factory Pittsburgh, or the landlord or any premises at which it may operate, for any lost, stolen, or broken personal, or otherwise, items. I also understand that, except for a monetary refund, I have no claims against Yoga Factory Pittsburgh, or the landlord of the premises, by reason of their refusal to allow me to participate in the Programs.
