This Release and Waiver of Liability (the “Release”) executed by the participant, or by their guardian in the case that the participant is under the age of consent, hereafter collectively referred to as (“Volunteer” “Me” “I”), releases Sewa International, (“Sewa” or “Nonprofit”), a nonprofit corporation organized and existing under the laws of the State of Georgia, registered in the State of California as a foreign corporation, and each of its directors, officers, employees, and agents.

I understand that the scope of volunteer service (“Services”) with Nonprofit is limited to a volunteer position and that no compensation and benefits are provided in return for Services provided by me to the Nonprofit. This Volunteer Service does not constitute as employment in any form and that Volunteer is responsible for his/her own insurance (including health insurance, disability insurance) coverage in the event of personal injury or illness or property loss as a result of Volunteer services to Nonprofit.

I understand that Sewa will be relying upon the statements put forth in this release, and for valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Volunteer hereby warrants, represents, and agrees as follows:

1. Waiver and Release: I, release and forever discharge and hold harmless Nonprofit and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise while providing Services to the Nonprofit or on behalf of Nonprofit. I understand and acknowledge that this Release discharges Nonprofit from any liability or claim that I may have against Nonprofit with respect to bodily injury, personal injury, illness, death, or personal property or vehicle damage that may result from providing the Services to the Nonprofit or occurred while I am providing Services.
2. Insurance: Further I understand that Nonprofit does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of Nonprofit beyond what may be offered at free will and in good faith by Nonprofit.
3. Medical Treatment: I hereby release and forever discharge the Nonprofit from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during at the volunteer work at my place.
4. Vehicle/Transportation: I understand that I shall use my own transportation /vehicle/car in compliance with local law and maintain proper insurance and valid driver’s license. In course of providing Services I am responsible for any and all liabilities arising out of use of my Car/Vehicle including any and all damages to the vehicle and injury to self and others.
5. Assumption of Risk: I understand that in connection with providing the Services activities may be hazardous to me including, but not limited to breaking walls, or removing carpets or handling personal properties or debris or paperwork and other activities involving inherently dangerous activities. I hereby expressly assume all associated risk of injury or harm and acknowledge that I have been warned that I must be in good health to participate in the Activities and affirm that I am in sufficient physical condition to accept a rigorous level of physical activity.
6. Photographs Videos/Audios: I grant and convey to Nonprofit all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by Nonprofit in connection with my volunteer Services.
7. Governing Law: As a Volunteer I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California and that this Release shall be governed by and interpreted in accordance with the laws of the State of California. I agree that in the event any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected. The parties irrevocably consent to the sole and exclusive jurisdiction and venue of the courts of California, for any action under this Release.
