In consideration of the privilege of borrowing the Solar House, the undersigned
(“Borrower”) assumes responsibility for the security, use, and transport of the Solar House and agrees to return the Solar House with all of the same parts, both interior and exterior, and in the same condition in which it was received. The Borrower assumes all liability for any damages or injury resulting from the use of the Solar House. The Borrower agrees to hold harmless and agree to indemnify the Illinois Solar Energy Association (“ISEA”) for all expenses, including legal expenses and or judgments, as a result of any damage or injury, whatever the cause. The Borrower attests that he/she/it is an ISEA member, or not-for-profit organization.
ISEA is not responsible for any personal items left inside the Solar House upon its
return. The Borrower agrees to be the sole user of the Solar House and that renting or lending the Solar House to any other person, organization, or entity is a violation of this Agreement. The Borrower agrees to return the Solar House in a timely manner as agreed upon with the ISEA Executive Director prior to borrowing the Solar House.
This Agreement and its application shall comply with all federal, state, and local laws, rules, ordinances, and regulations. If any provision of this Agreement, or the application thereof to any person or circumstance, shall be held invalid or unenforceable by any court of competent jurisdiction, the remainder of this Agreement or the application thereof shall not be affected, and shall remain in full force and effect. This Agreement constitutes the entire agreement with respect to the subject matter herein and supersedes all prior or contemporaneous oral or written agreements concerning use of the Solar House.
The Borrower has read and understands the above information. By signing this contract the Borrower attests that he/she/it may be held financially responsible for the cost to ISEA to replace or repair the equipment in the event the Solar House is damaged or stolen during the term of this Agreement in an amount not greater than $1,000. The Borrower takes responsibility and assumes all liability for the safe transport and use of the Solar House. Additionally, the Borrower agrees to hold ISEA harmless for any damage that may result from the transport and/or use of the Solar House.
