Terms of Service - PLEASE READ THESE!
Interested in commissioning us? Here are our Terms of Service (TOS), which is an agreement between us and you to assume certain responsibilities for submitting this form.  It sounds scary, but these are all pretty common-sense! :)

Terms of Service: Updated 11/2023

1. AGE:  YOU AND EVERYONE INVOLVED IN THIS COMMISSION (INCLUDING ALL CHARACTERS/'SONAS/AVATARS AND THEIR OWNERS) AGREE THAT YOU ARE 18 YEARS OLD OR OLDER!!!  We do not engage our services with anyone under the age of 18, nor do we provide our services in the depiction of any individuals who are under the age of 18.  If we discover that this term has been violated, the project will immediately be canceled and no more work will be done for this project. There are no exceptions!

2. SERVICE:  You agree that submitting a commission request form via this document is not a guarantee of receiving a commission from OwliGator Studios.  We always reserve the right to deny service to anyone for any reason with or without notice.  You also agree that submitting a commission form constitutes the intent to commission OwliGator Studios and will be treated as such in accordance with this Terms of Service document in its entirety.

3. STYLE:  When commissioning OwliGator Studios, you're commissioning for our style and skill level.  Please review our galleries for examples of our work before commissioning!  Please note that while we do enjoy drawing "big" and "exaggerated proportions," there are limitations that we will adhere to based on the composition of a piece that's being commissioned by you, the commissioner.  Pose, viewing angle, and characters/avatars/'sonas involved all work together to set hard limits on how large and exaggerated things can be drawn without causing issues that will ruin a piece's composition and overall appeal.  We will always lean more toward creating an image that looks nice and works well together, rather than leaning towards making things too large and breaking those hard limits.  Keep in mind that every piece is unique and a past example of our work representing a size or exaggeration you may want in your piece is not always possible.  You agree that any inclusion of references to exaggerated proportions that you send with this form, for the sole purpose of indicating how exaggerated you want such proportions for your own image(s), is likely to be ignored by the artists.

3a. "MULTI" CHARACTERS:  We have no issues with drawing characters who have additional "appendages" or "features."  However, our commission pricing only covers characters which have a "typical" configuration of appendages and features.  In this context, we, the artists feel that "typical" means:  One head, one torso, one pelvis, two legs/hindlimbs, two arms/forelimbs, one tail, one genital configuration, and two wings.  If more features and/or appendages than the ones included in a "typical" configuration are required to draw a character/avatar/'sona, then we will, at our discretion, assess a fee for the additional features/appendages.  This fee will be assessed at $10 USD - Flat Color/$15 USD - Cel Shaded/$20 USD - Rendered, for every two additional features/appendages included (rounded up).  As always we reserve the right to refuse to draw any character which possesses a number of additional features/appendages which we feel is in excess of what we are feasibly capable of including in any commission.

4. AI, NFT, & CRYPTOCURRENCY:  We, the artists, explicitly do not give permission for any of our works to be used in the training of any AI algorithm's content generation; the making of NFTs; and/or the creation of Cryptocurrency products, tokens, or other formats.  As the commissioner, you agree that you are not engaged in commissioning us with the intent of using the resulting artwork for any of the aforementioned reasons, or any of their associated products or processes, or with the intent of allowing any other individual or group to do the same.  You, the commissioner, agrees that this ToS section persists after the conclusion of the commissioning process into perpetuity.

5. PERMISSIONS FOR CHARACTERS:  By submitting this commission request form, you agree that all characters/avatars/'sonas mentioned within the form are either owned by yourself or that you have obtained explicit written permission by the owners of those characters/avatars/'sonas to have their image(s) and likeness(es) drawn in the commission being requested.  As is mentioned in our "Will Not Draw" list, we do not draw any "Rule34" or otherwise copyrighted characters owned by companies, studios, or other such businesses or artists without the express written consent of these owners.  Some leeway may be granted with various "races" and/or "species" created by various popular franchises, but this is always at our sole discretion and always on a case-by-case basis.

6. ACCEPTANCE RESPONSIBILITIES:  Once a commission is accepted, an email will be sent to you, the commissioner, along with an invoice (typically from PayPal). This invoice must be paid within 24-48 hours. We may, at our discretion, extend this expected time limit if we are notified via reply to the acceptance email that you will be sent.  You, the commissioner, agrees that all communication needs to be expedient and prompt. Exorbitant delays may result in exclusion from the current commission queue and future commission consideration.  We, the Artists, reserve the right to refuse any commission request with or without explanation.  If you, the commissioner, are the point of contact for this commission and are representing other interested parties (aka, you and others pooled for this commission) then you agree that it is your responsibility to ensure that all other interested parties receive a copy of this ToS and any email correspondence which has been generated in the interest of pursuing your commission project, up to and including completion of the commission.

7a. WORK-IN-PROGRESS (CUSTOM ILLUSTRATIONS & CONVENTION BADGES):  Work-in-Progress (WIP) updates will be provided at certain specified points in the commission process:  The Initial Sketch, Inks, and Flat Colors. At each of these WIP steps, the commissioner is allowed one revision request (also known as an "Edit Pass") at no additional charge (that is, one email response where all edits to that WIP step must be requested, simultaneously).  Any additional revision requests beyond the first for each WIP step, individually, or any revisions that require significant changes to the WIP step WILL RESULT IN ADDITIONAL REVISION FEES.  Once you have provided us with approval for a WIP step, we will NOT go back to make additional edits that need to be made at that step!  The email communication which we, the artists, will send with each WIP step explains in detail which elements of your piece we will focus on and which edits you should ask for at that time.

7b. WORK-IN-PROGRESS (REFERENCE SHEETS):  (Same as section #7a, with the following exceptions:)  "...At each WIP step, the commissioner is allowed up to three (3) revision requests at no additional charge.  No additional revision requests are available after the third (3rd).  If a commissioner requests all three (3) of their edit passes, we will assume approval on the completion of the third (3rd) edit for that particular WIP step and move forward with the next step, or with the completion of the image, depending on which step is being worked on at the time."

7c. WORK-IN-PROGRESS (YCH STICKER PACKS):  (Same as section #7a, with the following exceptions:)  "...Work-in-Progress (WIP) updates will be provided at certain specified points in the commission process:  The Inks and Flat Colors..."

8. COMMISSIONER APPROVAL:  As the commissioner, it is your responsibility to check a WIP image thoroughly before giving approval to move on to the next step.  DO NOT ASSUME THAT WE GOT EVERYTHING RIGHT IN EACH WIP!!!  As artists, we make mistakes, especially if we are not as familiar with a character we're being asked to draw.  We must rely on the commissioner to indicate whether we are ready to move on to the next step in a commission's progress, or if edits need to be made.  Once a WIP step has been approved, we will not go back and make any additional edits which needed to be requested at that approved step.  No exceptions!

9. TURNAROUND & TIMETABLE:  We, the artists, guarantee a 4-5 week turnaround for our work.  If, for some unforeseen reason, we are unable to make this turnaround deadline, we will send you, the commissioner, written notice of the delay.  You, the commissioner, agrees that we, the artists, must also treat this 4-5 week turnaround deadline as an enforceable deadline for the completion of all images in a month's queue.  If, we, the artists, experience delays in our workflow because you, the commissioner, have created those delays via slow response time for any reason, we reserve the right to take action to ensure that your commission is keeping pace with the general flow of our queue, up to and including completing a commission with written notice.  See Section #10 for more details. 

10. COMMUNICATION & TIMING:  Communication regarding commissioned work will only be done via email.  As the artists, we promise to keep you informed as to the status of your commission.  We do this primarily by sending WIP emails to the contact email you provide to us when you submit this form, but we also will do our best to reply to any email questions within 24-48 hours of your sending them.  As the commissioner, it is your responsibility to respond in a timely manner to any WIP emails and/or other emails regarding your commission.  This is so that we can keep our commission queue deadline noted in section #9.  If we don't receive a response from you after 2 days of sending an email which requires response, we will send an initial reminder email.  If 3 days have elapsed without a response from you regarding the WIP which was sent, we will send a final reminder email.  If 4 days (or more) have elapsed without a response from you regarding the WIP which was sent, we will assume that the most recent WIP has been approved and move on to the next step of the commission.  If necessary, we will complete the commission in its entirety and deliver it to you in a final email.  A commission step that has received approval and/or has been completed in this way is not entitled to the edits granted to other commissions during the commission process (see Section #7a, #7b, or #7c. WORK-IN-PROGRESS...), and we will not go back to edit the commission in any way for any reason without the purchase of a Commission Update in a subsequent queue.  Please keep in mind, a "response" as mentioned in the context of this section is an email reply that contains:  A) approval of the current WIP or, B) a request for edits to the current WIP.  Email replies that contain anything else do not qualify as "response" in the context of this section.  We, especially, do not accept requests for more time to review the WIP and/or any attempt to explain why responses have been/will be slow as a "response" in the context of this section.

11. CANCELLATION POLICY:  We retain the right to cancel your commission at any time with written notice. We reserve this right, specifically, if violation of this TOS is discovered at any point during the commissioning process.  You, the commissioner, agree that a cancellation of your commission in this context does not necessarily mean that your commission will be refunded, depending on the specific situation surrounding the cancellation and how much work has been put into the commission before it needed to be cancelled.

12. REFUND POLICY:  Refunds may be requested at any time until completion of the commission.  A refund request will generally cause a commission to become cancelled and all work will be halted on the image.  If a Sketch has not yet been produced, a refund for the full amount may be requested.  If a Sketch has been produced, we can only refund up to 50% of the full commission fee.  If the Inks have been completed, we cannot offer any refund.  You, the commissioner, agree that any abuse of the refund policy may result in exclusion from future commission consideration.  Any refund consideration must be handled by we, the artists, directly.  Please do not involve PayPal or any affiliate payment companies through which payment of your commission has been handled.  Failure to comply will result in permanent exclusion of any and all future commission considerations and we may communicate this failure to comply with other artists and/or studios with which we are affiliated in order to protect them from any potential future activities concerning doing business with you, the commissioner.

13a. DELIVERY (CUSTOM ILLUSTRATIONs, REFERENCE SHEETS, & CONVENTION BADGES):  At the conclusion of our business with the commissioner, high-quality .jpg and .png files of the finished piece will be delivered via email. You, the commissioner, agree that these files constitute the finished product and also the fulfillment of these Terms of Service to the satisfaction of all parties involved.  We do not provide basic art files (reference material files and/or .clip files and/or .psd files) as a part of the finished product and we reserve the right to keep these files in storage on our studio server or other storage devices/methods indefinitely and at our discretion.  We, the artists, give explicit permission to reproduce via copying and printing onto physical media, any of the files that we have delivered to you, the commissioner.

13b.  DELIVERY (YCH STICKER PACKS):  (Same as section #12a, with the following exceptions:) "At the conclusion of our business with the commissioner, high-quality .png files with transparent background for each finished sticker will be provided..."  "...We, the artists, give explicit permission to use these images to create "stickers" on any and all chat media programs (such as Telegram and Discord)."

14. POSTING ARTIST CREDIT, & RE-POSTING:  Agro Alba's signature and the OwliGator Studios logo must remain on any and all images created by us, and may not be manipulated or altered without written permission. Re-posting is allowed with appropriate artist credit, though some special permissions may be required if the re-posted work contains original characters which belong to anyone who is not the individual performing the re-posting.

15. AGREEMENT:  You, the commissioner, by completing and submitting this commission request form, state that you have read and agree to all parts of these Terms of Service.  If your commission request is accepted, we will attach a copy of this TOS to the acceptance email you will receive at that time, for your records.

*Gratuitous Digestion (Implied digestion is okay)
*Nipples that are any shape other than "nipple shape" (Dicknipples, Cuntnipples, Etc)
*Tail Maws
*Flatulence
*Scat
*Vomit
*Watersports
*Visible Stink, Musk, and/or Sweat Steam
*Internal Views (Regardless of which part of a character the view is coming from)
*Panels and/or Side Panels (Except as appropriate on Reference Sheets)
*Alternate Image Versions
*Distinct or Gratuitous Bulges in Bellies or Balls (Whether vore or penis insertion-related)
*All-The-Way-Through Scenarios (Including penises, tentacles, tendrils, and cum)
*Cock & Ball Torture
*Anal and/or Vaginal Prolapse (Rosebud)
*Rule 34 and/or Copyright Characters from Franchises We Do Not Own
