By commissioning me, you are agreeing to the following terms.

This document can and will be edited at any time without the need of further notice.

Type of commission

• As of right now, digital art is the only form of commission I do. You will receive a file of the artwork. No physical copies of artwork are included.

General Guidelines

• I am disabled and have chronic pain as well as RSI, so if you need the commission by a certain deadline we can discuss this prior to your payment.

• I only take commissions from people 18+.

• Please include clear references and a detailed description that is easy to understand. The more information the better. I have comprehension problems so if something has been misunderstood please kindly let me know, I will not be offended!

• I will draw: OCs, Fanart, NSFW, Real people, Pets, Furries, Some blood/wounds

• I will NOT draw: NSFW of (non-consenting) real people, Gore, Specific or niche fetishes, Mecha, Vehicles, Intricate designs, Loli/Shota NSFW, or NFTs

• If you are commissioning NSFW of real people, I must have proof of everyone involved's consent.

• If your reference includes an intricate design, I will attempt to simplify it as best as I can without completely removing it. 

• If you do not have a reference and only have descriptions, I will charge extra for having to design it. 

• I have the right to decline a commission for any reason.

• Commissions over $100 require a contract.

Contract

Commissions over $100 require a contract for the safety of both parties. After reading the TOS and agreeing, please use my business email vivibuniart@gmail.com. Should you contact me via social media I will ask that you email me the details as it is easier to organize, however initial contact and inquiries may be done over social media. 

Payment

Payment is upfront. I do not move the money into my spendings until the commission has been delivered. These are my payment methods, so if you have a preference please let me know!

Process

• I will send you screenshots of the initial sketch (or some choices between sketches) and any revisions needed will be done if necessary. I will update you multiple times over the course of the commission until completion.

• Minor revisions are able to be done anytime (change a colour, small details) but major revisions (changing pose/hairstyle/clothing etc) can only be done during the sketching phase and will cost 25% to 30% more depending on what the change is if it is requested after linework or colouring has been started.

Usage and Copyright

• Artwork done by me is for personal use only; no commercial use. You may not profit from it or sell any prints/products. You may make prints for personal use.

• NO ONE is authorized to create or sell NFTs using my work.

• NO ONE may use my art for the purposes of training AI or creating AI "art"

• You may resize or crop the artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but you cannot alter the artwork itself.

•You may not remove any signature or watermark from the work.

• I hold the right to stream my drawing process and post my works. Should you want your commission to be private, there will be a 50% additional fee.

• You may upload your commission to social media as long as you credit me. If left uncredited I will ask you to add it, and only if needed I will submit a copyright claim.

• I reserve the right to reuse poses, sketches, and design elements that were rejected by the commissioner for other commissions or personal works.

• A Purchase of Commercial rights to the artwork will always be 300% of original price. With commercial rights you are allowed to make any sort of profit with the artwork. You may alter it as you wish or use it to promote your brand. Credit is still required for usage of the artwork, even if altered or edited.

Refunds and Cancellations

• If you wish to cancel your commission during the sketch stage you will be refunded 50% of what you’ve paid.

• If you wish to cancel your commission after the sketching stage, there will be no refund.

• You’ll receive a full refund if for any unjustifiable reason I’m unable to finish the commission.
