This waiver & declaration must be completed prior to starting in person tutoring.

The novel coronavirus, COVID-19 has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is known to spread mainly by contact from person to person. Consequently, local, provincial and federal governmental authorities recommend various measures and prohibit a variety of behaviors, in order to reduce the spread of the virus.

Totally Tutors Inc and its Tutors commit themselves to comply with the requirements and recommendations of Ontario National, Provincial and local Public health and other governmental authorities. However, Totally Tutors Inc. cannot guarantee that you or your child, (if participant is a minor/ or the person you are the tutor or legal guardian of) or a family member will not become infected with COVID-19. Further, in-person tutoring could increase your (or your child, if participant is a minor/ or the person you are the tutor or legal guardian of) risk of contracting COVID-19, despite all preventative measures taken by the tutor.

By signing this document,

1) I understand that interacting in-person involves risks.  There are risks associated with participation in the tutoring and academic support programs offered by Totally Tutors Inc., such as illness arising from disease or infection (e.g. COVID-19 pandemic or any other virus or bacteria or other pathogens), and that such disease and infection can lead to long-term or chronic side-effects or even death.

2) I also acknowledge that children can pass on disease and infection to other family members, and that elderly family members and those with other medical conditions (diabetes, obesity) and the elderly are at particular risk. There are risks associated with my family members (spouse/partner, child/children) being exposed indirectly via the Totally Tutors program, e.g. having a tutor visit in my home.  I hereby acknowledge these risks and I give permission for members of my family to participate in these programs and to be exposed to these risks.

3) I declare that I (or my child, if participant is a minor/ or the person I am the tutor or legal guardian of) am participating voluntarily in in-person tutoring programming.

4) I declare that neither I (or my child, if participant is a minor/ or the person I am the tutor or legal guardian of) nor anyone in my household, have experienced cold or flu-like symptoms in the last 14 days (including fever, cough, sore throat, respiratory illness, difficulty breathing).

5) If I (or my child, if participant is a minor/ or the person I am the tutor or legal guardian of) experience, or if anyone in my household experiences any cold or flu-like symptoms after submitting this declaration, I (or my child, if participant is a minor/ or the person I am the tutor or legal guardian of) will cancel the session due to sickness and there will be no charge for a cancellation even if not within the 24 hours period required.  


6) I (or my child, if participant is a minor/ or the person I am the tutor or legal guardian of), nor has any member of my household travelled to or had a lay-over in any country outside Canada, or in any Province outside of Ontario, in the past 14 days. If I (or my child, if participant is a minor/ or the person I am the tutor or legal guardian of) travel, or if anyone in my household travels, outside the Province of Ontario after submitting this declaration, I (or my child, if participant is a minor/ or the person I am the tutor or legal guardian of) will cancel the session due to sickness and there will be no charge for a cancellation even if cancelled within the 24 hours period required.  

 
7) I (or my child, if participant is a minor/ or the person I am the tutor or legal guardian of) agree to the requirements and recommendations of National, Provincial and local Public health and other governmental authorities as it pertains the Covid-19 Coronavirus and to adopt all necessary measures to those effects.

8) I further irrevocably release and quitclaim Totally Tutors and its directors, officers, employees, contractors and tutors of liability from and against all injuries, claims (regardless of the cause of action), demands, actions, proceedings, causes of action, awards or costs (herein collectively a “Claim”) that may arise out of my participation and participation by me and my immediate family members, including my non-adult child/children’s participation in, or interaction with, the programs of Totally Tutors, INCLUDING WITHOUT LIMITATION CLAIMS BASED ON THE NEGLIGENCE OF TOTALLY TUTORS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS AND TUTORS.  In the event that any Claim is brought against TOTALLY TUTORS or its directors, officers, employees, contractors or tutors, by me, or by any of my family then I agree to defend TOTALLY TUTORS and its directors, officers, employees, contractors and tutors from all such claims, INCLUDING WITHOUT LIMITATION CLAIMS BASED ON THE NEGLIGENCE OF TOTALLY TUTORS AND ITS DIRECTORS, OFFICERS, EMPLOYEES AND TUTORS. I hereby irrevocably indemnify and hold harmless TOTALLY TUTORS and its directors, officers, employees, contractors and tutors of liability from and against all Claims arising from or by my spouse or children arising from our interaction with Totally Tutors.
