2nd Annual MATCO Tools Car Show hosted by White Tank Customs & Classics
ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AGREEMENT

IN CONSIDERATION of the acceptance of my registration and the benefits of my participation in the 2nd Annual MATCO Tools Car Show, I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE White Tank Customs & Classics and their affiliates, divisions, sub groups bearing similar name, assigns, successors in interest, agents, servants, employees, volunteers, officers, trustees and directors, past and present, and each of them (here out collectively the “Released Parties”), from any and all liability, claims, demands, actions and causes of action whatsoever, including attorney’s fees, arising out of or in any manner related to my participation in the event, including any loss, damage, injury or death that may be sustained by me or my personal property, whether caused by the negligence of the Released Parties or otherwise.

The Released Parties reserve the right to refuse admittance to or to dismiss anyone for unacceptable and / or unfavorable conduct at our discretion. Including, but not limited to belittlement, disparaging words, donuts, burnouts, racing and / or any other reckless endangerment.

I understand that participation is completely my choice, and I choose to participate for my own personal benefit. I am fully aware of the risks involved with participation, and I expressly, voluntarily and willingly ASSUME FULL RESPONSIBILITY FOR ALL RISKS AND DANGERS associated with such participation, including, but not limited to, risk of bodily injury (including permanent dismemberment, disability or death) or property damage arising out of my participation, howsoever caused, and I accept personal responsibility for the damages arising from any such injury or property damage and hold the Released Parties harmless there from.

I understand the Released Parties provides no guard service or surveillance of the premises; however, I, the exhibitor, am responsible for my own property. I acknowledge it’s my responsibility to remove any property not securely fastened to my display when my exhibit is not occupied. Including, but not limited to, lawn chairs, keys, wallets, and purses.

I expressly waive any defense to enforcement of this agreement arising from any claim of lack of consideration and understand that this agreement constitutes a legal, valid and binding waiver of my rights and shall be enforceable against me, my spouse, family, heirs, assigns, personal representatives and estate for all purposes.

I understand all monies collected for participation in the 2nd Annual MATCO Tools Car Show are considered a donation with intent to give proceeds to Phoenix Children’s Hospital and as such are non-refundable.

I understand that my display(s), exhibit(s), automobile(s) and I may be photographed or filmed during the event and agree to allow the Released Parties to use any photograph, audio, video imagine or film likeness of me or my automobile(s)/motorcycle(s)/motor vehicle(s) for any legitimate purpose, including without limitation publication and program inclusion now and in the future, without financial compensation to me, the exhibitor.

I acknowledge and agree that this agreement is binding on all heirs and assigns. I acknowledge and agree that this agreement is irrevocable, worldwide and perpetual. This agreement contains the entire agreement between the parties to this release and the terms of this agreement are contractual.

I have carefully read this agreement, and my participation in the 2nd Annual MATCO Tools Car Show acknowledges that I fully understand its content and meaning. I understand that I have given up substantial rights by concurring to this agreement, and I concur to it freely and voluntarily without any inducement. If I am concurring to this agreement on behalf of a minor, I certify that all representations are true and that I have full authority to bind the minor and myself to the terms and conditions of this agreement.
