I/We, the undersigned (electronically) hereby bind ourselves as Sureties and Co-Principal Debtors, jointly and severally to:-

(hereinafter referred to as the Creditor)
for the due and proper fulfillment of all the obligations of
(hereinafter referred to as the Debtor)

for the due payment of all monies and the due-fulfillment of all obligations howsoever arising, which are now due and owing and or payable or which in the future will become due, owing and payable by the Debtor to the Creditors.

I/We agree and declare that:-
1. No act of indulgence, relaxation or grace granted by the Creditor to the Debtor (including any act of accepting payment after due date or in accepting a lesser sum than the amount due) shall prejudice or affect the Creditor's rights in terms hereof.
2. This Suretyship shall remain in force as a continuing covering security until such time as all the obligations of the Debtor to the Creditor have been duly and properly fulfilled.
3. I renounce the benefits of excision, division and cession of action, the full meaning and effect whereof I know and understand.
4. The Creditor shall be entitled at its option to institute any legal proceedings which may arise out of or in connection with this Suretyship in any Magistrate's Court having jurisdiction in respect of the Surety's person, notwithstanding the fact that the claim or value of the matter in dispute might exceed the jurisdiction of such Magistrate's Court in respect of the cause of action.
5. If this Deed has been prepared in form for signature by more than one Surety, then each Surety who signs it acknowledges and records that notwithstanding the fact that it provides for signature hereof by other Sureties, there is a separate, distinct and independent contract of Suretyship brought into existence by each Surety who does sign it. Accordingly if for any reason any Surety named herein shall fail to sign this Deed of Suretyship for any reason whatsoever or if this Suretyship shall for any reason cease to be or is not binding on any one or more of the Sureties then the obligations of the other(s) shall be and continue to be binding and remain of full force and effect in terms hereof.
6. It is agreed and declared that all admissions and acknowledgements of indebtedness by the Debtor(s) shall be binding on me.

8. The Surety shall be responsible for all charges and expenses of whatsoever nature and howsoever arising incurred by the Creditor in securing the performance of the obligations of the Debtor or the Surety, or enforcing the rights of the Creditor, including, without limitation, all legal costs, including attorney and own client costs, collection commission and fees of tracing agents.
9. No variation, relaxation, waiver of, addition to, deletion from or cancellation, whether consensual or not, of this Suretyship or any of the terms thereof (including this clause) shall be of any force or effect unless reduced to writing, signed by the Surety and confirmed by the Creditor in writing.
10. The Creditor is irrevocably authorised to apply any monies received by the Creditor from the Debtor or any Surety whether in terms of this Suretyship or not against the indebtedness of the Debtor to the Creditor in such manner as the Creditor in its entire discretion may think fit, including the appropriation by the Creditor of monies received to any obligation of the Debtor whether due for performance or not for which the Surety is for any reason not liable.
