Hello, thank you for being interested in commissioning me! In this document, “the artist” or “me/myself/I” refers to myself, Jacquelyn Kruzic (pen name Vierdz), and “the client” or “you” refers to the person or entity who is purchasing my service and entering into this contract.

Please do not submit this form until the ToS has been fully read, fully comprehended, and fully agreed to.

Things I will not draw:

- I will not draw pornographic NSFW content (some nudity is ok, please ask).
- I will not draw fetishes, extreme realistic gore, pedophilia, hateful images, modern military themes, real individuals, self-harm, and drug use.
- I will not draw a character if they appear to be or are a minor.
- I don’t like drawing obscure jokes, most fanart, or fan characters.
Please look through my Carrd website and picture how your commission might fit into the rest of my art.


Production:

- First, read this ToS!
- Fill out the Order Form to pitch your commission. I’ll respond if I’m interested!
- We’ll communicate further via e-mail (not Discord, Twitter, etc) regarding the commission.
- Price and payment or a payment plan will be established and agreed upon by myself and you.
- “Work in progress” or WIP images are provided based on the level of detail of the commission which is determined on the commission order form. For example: Thumbnail WIP --> Sketch WIP --> Color WIP --> Final Details (Finalized)
- Please only request edits on WIP drawings. Edits after the Finalized stage will cost extra unless it's something I feel like I missed (such as a key feature of a character, a prop that was originally requested but not included, etc).
- Time to completion varies depending on level of detail and my IRL schedule.
- No due-dates.

Pricing/Payment:

- PayPal only.
- Payment is due upfront unless the total cost of the commission is $300 or over.
- Complexity of the commission (multiple characters, patterns, wings, environment, props, costume, etc) increases the pricing. Keeping the design simple, or requesting for a loosely drawn interpretation of a complicated character design, will result in a lower price.  
- Payment plans are determined before production.
- Personal or commercial use of the artwork determines the pricing; purchasing commercial use of the artwork requires an extra fee to be discussed.
- Until the final payment is made, the client will only receive a low resolution copy of their work. In order to obtain the high resolution final files, the client must fully pay the artist.
- Edits: Between WIP images, edits are free. I can, however, charge the client depending on how intensive the edits are after the final drawing is sent. The "final drawing" is the drawing rendered to the agreed amount that was established at the beginning of the commission process after the initial payment was made. For example, changing a black and white sketch drawing to a fully rendered illustration partway through the process or at the end of the process does require more work.


Refunds:

- If the artist completes the drawing there is no refund.
- If the artist is unable to complete the drawing, a full refund will be issued.
- If the client decides to drop the project during production, any existing payments will not be refunded.
- Failure to pay the artist in full within the established deadline will result in being black listed.
- Should the client break the ToS, or is discovered to be rude or bigoted in their behavior and/or actions towards the artist or towards the public, the artist reserves the right to cancel the commission without a refund.


Artist's Terms and Rights:

- The client must be at least 18 years old.
- All work that is displayed online will include my watermark and/or signature, removal of this will result in the client being blacklisted (using my work as a social media avatar is ok if it crops out my watermark and/or signature, be sure to credit me in some manner, such as a link to my Carrd or social media).
- Should poses/compositions be rejected by the client, the artist has the right to recycle them for future projects or commissions. Character designs, IPs, and anything else belonging to the client will not be included in this.
- Excluding copyrighted IPs, the artist reserves the right to use created artwork for prints, art books, and similar media, and to self advertise, unless explicitly stated prior to the beginning of production.
- The client reserves the rights and ownership to their characters, concepts, logos, and intellectual properties.
- The client agrees that all character, concepts, logos, and intellectual properties being displayed in the artwork is legally owned by them.
- Altering the artwork or falsely claiming it as the client's own work or someone else's work will result in being blacklisted.
- The client does not hold the right to resell or earn money using the artist’s work without first purchasing commercial rights.

Please do not contact me using any other service such as social media or Discord for a commission, all business must be done over email in order for the transaction to be valid. I do not check my email on Sundays. Please allow up to 3-5 business days for a response.
