BANGOR SCHOOL DEPARTMENT                    Release to waive Family Education Right to Privacy Act (FERPA) for a Zoom meeting

May 7, 2020

Dear Parent/Guardian,

As you may be aware, last week students who did not have access to computers and internet were issued laptops and hotspots so that the students could be electronically connected to schools and teachers. Once all students had technology regular education teachers began to have contact with their classes through Zoom.

Bangor School Department is committed to maintaining the confidentiality of student education records under the Family Education Right to Privacy Act (FERPA). Information from education records of students with IEPs is also confidential under the Individuals with Disabilities Education Act (IDEA). As part of this commitment to protecting student privacy, access to classrooms is generally limited to students, staff and other authorized individuals. While technology such as Zoom permits groups of students and staff to meet remotely, it is not possible to control the learning environment in the same manner when students are participating in activities from their homes, as when they are attending school. For students who have 504 Plans, participation in group activities with a teacher and other students via Zoom may mean that others outside the class, including other students and parents could learn that the student has a disability and receives accommodations.

Many parents, students and teachers appreciate the ability to provide some of the social connection to school through these Zoom experiences, and they would like their child to participate in group format. Bangor School Department recognizes the need to balance appropriate consideration of the privacy implications of videoconferencing with its potential benefits.

Bangor School Department will allow teachers to continue to have classroom Zoom meetings with groups of students if written parental consent is provided. If you would like to have your child participate in a Zoom meeting with their teacher and classmates, please complete the digital consent form by answering the questions and acknowledging the information provided below, then hit submit.
