In light of the current pandemic situation due to the novel coronavirus (Covid-19) New Mexico Institute of Mining and Technology (NMT) has undertaken certain cleaning procedures as well as other actions as recommended by The World Health Organization, the Center for Disease Control, The State of New Mexico Department of Health and other healthcare agencies in order to limit the potential transmission and spread to Covid-19.  In addition, NMT has informed me of the need to maintain appropriate social distancing of six (6) feet and the need to wear a facial covering where appropriate. Despite these recommendations and actions, it is impossible to guarantee transmission or spread of Covid-19 will not occur. As a result, the undersigned  (and on behalf of a minor if indicated) agrees and acknowledges that by participating or using NMT facilities and programs may involve inherent danger and risk, including without limitation, the risk of physical illness or injury, death, or property damage.

The undersigned and on behalf of such minor(s) further warrant and represent that neither shall visit or utilize the facilities, services, and programs for NMT if either experience symptoms of COID-19 including without limitation, fever, cough or shortness of breath, or has a suspected or diagnosed/confirmed case of COVID-19 or have traveled outside the state of New Mexico within two weeks of the sport club event/activity. The undersigned further agrees to notify NMT immediately if he or she believes they are experiencing such symptoms.

In consideration of the opportunity to participate in and be a sport  club team member, I, on behalf of myself, my agents, heirs, and next of kin, (collectively, “Participant”) hereby agree to release, hold harmless and discharge Regents of New Mexico Tech and its employees, agents and representatives (collectively, “University”) from any responsibility, liability, claims, demands, actions, and cause of action whatsoever arising out of or related to any personal injury, including death, and damage to or loss of property or expense, that Participant may incur while traveling to or from, engaged in practice or competition, being coached, triaged by trainers/EMT, using or operating equipment or otherwise participating in a sports club activity. Participant is aware that participation in NMT Sport Clubs involves risks, dangers and hazards, including but not limited to the risk of serious injury or death and negligence on the part of the University, which includes failure by the University to take reasonable steps to safeguard or protect Participant from injury or from risks, dangers and hazards of participation in NMT Sport Club Activities. Many of the NMT Sport Clubs are unsupervised. Participant understands it is their responsibility to learn about and understand the risks, dangers and hazards of participating in NMT Sport Clubs. Participant understands that this release includes releasing the University from any financial obligations or liabilities, including attorney's fees and court costs, that Participant may incur while participating in the Club, or while engaging in independent, non-Club-supervised activities tangential to participation in Club activities, that result from Participant’s own acts, errors or omissions.

Participant understands that the University does not provide medical insurance coverage for participation in NMT Sport Clubs and that Participant, must provide their own personal medical insurance. In the case of injury or medical emergency and in the event that Participant cannot respond at the time of that emergency, the University has permission to seek, administer, or have administered whatever first aid or emergency medical care deemed necessary for Participant’s welfare. Participant, and not University, shall be responsible for any and all charges for all health care services regardless of whether Participant medical insurance would cover the charges.

Participant certifies that to Participant’s knowledge there is no medical reason limiting Participant from safely participating in the Sport Club identified above. It is the responsibility of the participant to maintain their wellness (e.g. proper rest, nutrition, hydration, etc.), be physically fit to participate, and address any potential deficits (e.g. weaknesses, past injuries, etc.). Furthermore, Participant agrees to obey all municipal, state, and federal laws, as well as New Mexico Tech’s policies and the Sport Club Code of Conduct while engaged in club activities or en route to, or from, same.

Participant recognizes that every Sport Club activity has a certain degree of risk, and having full opportunity to consider the risks, knowingly and voluntarily assumes the risk of any injuries, regardless of severity, including death, and all risk of damage to or loss of property and expenses which Participant may incur, am participating in a Sport Club activity.

This Release and Hold Harmless Agreement is binding the Participant, and shall be effective from the date of signature until August 1 of the following Calendar Year.
Prior to signing this document, I have had an adequate opportunity to read and understand it, have had an opportunity to ask questions about it, and any questions I have had have been answered to my satisfaction. *
