2021 TUCSON FOLK FESTIVAL - ARTIST PHOTO, VIDEO, AND BROADCAST RELEASE FORM & HOLD HARMLESS
This Agreement covers all Audio/Video/Photo performances produced by the Artist(s), willingly submitted to the Tucson Kitchen Musician’s Association (TKMA) or created by TKMA during a promoted event, such as the Tucson Folk Festival, for the purpose of TKMA members and audience viewing on their website, by and between
The Tucson Kitchen Musician’s Association, PO Box 41054, Tucson, AZ 85717 and the Artist(s) listed below.  
TKMA is a 501(c)(3) non-profit organization; tax ID #86-0514808.

The undersigned Artist(s) hereby grant permission to the Tucson Kitchen Musician’s Association
(TKMA) to photograph and video record their voice, their musical performances, appearances, and to use Artist(s) picture, photograph, silhouette and other reproductions of Artist(s) physical likeness and sound as part of the annual Tucson Folk Festival and/or The Stefan George Memorial Songwriting Competition for the distribution, advertising, or exhibition by TKMA in its discretion for the benefit of its members and for promotional purposes.

The Artist(s) agree that they will not assert or maintain against TKMA, its representatives, successors or assigns, any claim action or suit or demand of any kind whatsoever, including but not limited to, those grounded upon invasion of privacy, rights of publicity or other civil rights or for any other reason in connection with TKMA’s authorized use of the above materials.
 
This Agreement shall run in perpetuity as long as TKMA exists.  The Artist(s) may request performances be withdrawn at any time for any reason by written notice to TKMA at the address above.  TKMA will endeavor to protect the Artist(s) intellectual property from piracy or other misuse.

Any additional audio/visual performances submitted to TKMA by agreement with the Artist(s) will be made available for the use of their membership, for the general Tucson Folk Festival audience, and for use by TKMA in promotional materials. The Audio/Video performances will not be downloadable or accessible to being copied for any use by members of TKMA or other persons.

The undersigned Artist(s) agree to permit TKMA this limited use of their otherwise copyrighted material exclusively for the purposes stated above.

BROADCAST DETAILS FOR 36TH ANNUAL TUCSON FOLK FESTIVAL
Artists will have their performances recorded and streamed during the Tucson Folk Festival and broadcasted directly from each stage by a professional video production teams. All stages will have a multi-camera broadcast with hi-fi board audio in the feed. TKMA will have the Folk Fest in its entirety streamed to Vimeo, Facebook, and possibly other platforms available for free viewing to the general public. Viewers are encouraged to donate to the festival to help us defer this production cost. After the festival, each Artist(s) will have their set broken out of the overall Folk Fest streams, and it will be made available as a standalone link on Youtube. It may take us up to a month to create individual performer links for each set.

Because all stages are being broadcasted this year to ensure public access to the free Tucson Folk Festival, all performers are required to accept this photo / video / broadcast release to perform.

The Artists may utilize their recorded performance in any manner they may deem appropriate. The artists shall retain all rights to their performances, including, but not limited to publishing and copyright.

The livestream broadcast addition to the festival is TKMA’s way of saying THANK YOU FOR YOUR FESTIVAL PERFORMANCE and we hope to see you next year. They are a record of your complete performance, straight-through, including introductions, applause, and talking between songs. The length of your performance on the day of your performance will be the length of your video from beginning to end. We expect sound quality and balance in the videos to be much better than our previous direct-to-CD recordings and we are excited to provide them to you for streaming via our Youtube channel.

Please note that if you plan to distribute or sell a CD or DVD with your performance recording and or video, you are solely responsible for obtaining licensing and copyright permission on any non-original music to be included. Note that a synch license is required in addition to a music-only mechanical license for cover songs if you plan to sell/monetize the full audio/video file. These recordings from the festival are provided to you as they were performed, and TKMA is not responsible for how they are used. Please follow all copyright laws.
HOLD HARMLESS
I agree fully to hold harmless TUCSON KITCHEN MUSICIANS ASSOCIATION (TKMA), Tucson Folk Festival, the event locations, and any affiliate event partners in case of injury during my performance at the agreed upon event. Notwithstanding the availability and policy limits of any insurance the Artist, shall defend, indemnify and hold harmless TKMA and its trustees, officers, agents, representatives, employees and affiliate event partners ("TKMA’s Indemnified Parties") against any claims made or legal actions brought against any TKMA's Indemnified Party(ies) by any person or entity as a result of injuries, damages, expenses and losses actually or allegedly incurred by such a person or entity ("Liabilities") arising out of or relating to the Artist’s performance or failure to perform pursuant to this Agreement, except where the Liabilities are the result of the Indemnified Party’s own direct and sole negligence.
