NOTICE Regarding COVID-19:  During the COVID-19 pandemic, DDF will continue hosting birthday parties virtually and remotely while adhering to all government guidance regarding this unprecedented and ever-changing situation.  DDF appreciates your understanding and support during this time.  I understand and agree that, for virtual and/or remotely-hosted birthday parties, DDF cannot and shall not be held liable or responsible for any risk to the health, safety, or physical wellbeing of any dancer or other attendee, and I, as the party organizer and host of the party, hereby assume such risks on behalf of myself and all such dancers and other attendees, and I hereby release DDF from any and all liability, damages, costs, or expenses with respect to same, and covenant not to sue DDF with respect to or relating to same. I further indemnify and hold DDF harmless from any and all liability, damages, costs, or expenses (including reasonable attorneys’ fees and costs) incurred by DDF as a result of my violation of the foregoing. *

TIME OVERAGE SURCHARGE: I can request the party to extend beyond the planned end time. I agree to pay for any additional, unscheduled party time at $25/quarter hour or part thereof; provided, however, that in no event will DDF have the obligation to extend the party beyond the planned end time. *

DEPOSIT: $75.00 deposit is required at time of booking for all parties. The party deposit is non-refundable. *

ASSUMPTION OF RISK: By the very nature of the activity, dance carries risks of physical injury. No matter how careful the dance host and dancers are, such risks cannot be eliminated. The risks of injury includes minor injuries such as bruises and more serious injuries such as broken bones, dislocations, muscle pulls, or worse.  Sports or any activity that involves motion and rotation in a unique environment, carries with it a reasonable assumption of risk.  Downtown Dance Factory is bound by law to inform all party participants and/or their guardians of the risks involved in the activity of dance in general, and I agree to make all party attendees aware of same. In consideration for DDF providing its services, and in consideration of me having the benefit of those services, I realize, understand, and acknowledge the risks of injury involved and, intending to be legally bound, hereby agree to and shall assume the responsibility of such risks for myself and for each dancer and other party attendee and further agree to save and hold harmless Downtown Dance Factory, LLC, its members, staff, teachers, agents, contractors, and representatives, and all others concerned, and to indemnify them against all loss, liability, damage, and expense (including reasonable attorneys’ fees and costs associated with same) incurred or likely to be incurred relating to or resulting from such risks and injuries/damages. *

MEDICAL RELEASE:  I certify that, after inquiry about same, no participating party attendee has any condition that prohibits full participation in the activities at or provided by DDF. I assume all ordinary risks for myself and all party attendees, whether using the DDF facilities or participating in a virtual or remote party, and hereby release DDF, and/or any of its staff or teachers, for any injury or damage suffered in connection with said use of the facilities or participation. In case of emergency, if I cannot be reached or if emergency action is required or appropriate, I authorize DDF, its agents and staff, to contact and attempt to obtain necessary or appropriate medical attention for a party attendee. *
