WAIVER OF LIABILITY AND RELEASE

I understand that RVA FIT DAY will not be liable for death, injury, loss or damage suffered by through or contributing to by any cause whatsoever including but not limited to, any negligent (including gross negligence) act and/or omission or breach of contract on the part of RVA FIT DAY, its directors, any of its employees, contractors, independent contractors, any agents and any of its members. I agree that RVA FIT DAY premises will be entered and exited entirely at my own risk and that RVA FIT DAY equipment and facilities will, furthermore, be utilized at my own risk. I understand and agree that RVA FIT DAY will not be held vicariously liable for any loss or damage suffered by me and/or other members as a result of theft on the part of its employees, independent contractors, consultants, or other members. I agree that as participating at  RVA FIT DAY that I, and/or my estate, indemnifies RVA FIT DAY against any claim by any person arising directly or indirectly from my death, injury, loss or damages suffered by a member, allegedly caused or contributed to any act or omission by RVA FIT DAY, its directors, employees, contractors, consultants and agents.
