1. I understand that a membership with MFit Gym is voluntary, and by joining, I assume certain risks, these include risk of physical injury, risk of infectious disease (by using equipment that is used by others), and the like. By joining MFit Gym, or by participating in its activities, I agree to assume all such risks and further agree to indemnify and hold MFit Gym from any/all claims that I may have, or damages that I may incur, as a result of my activities. This indemnification of MFit Gym extends to its owners, employees, agents, and other representatives, heirs, and assigns. 2. In consideration of the inherent risks that I have assumed, as set forth above, I am representing to MFit Gym that I or my child is of adequate health to participate in physical fitness activities, and that I have no known physical or mental limitations, I agree to terminate my membership and immediately discontinue use of the MFit Gym facility. 3. I understand that the role of the owners, employees, agents, and other representatives of MFit Gym is to administer the operations of the fitness center and is not to provide me or other members with health, or physical fitness diagnosis, treatments, or other forms of medical advice. 4. MFit Gym and its owners, employees, agents, or other representatives are not responsible for my personal property that may be lost, stolen misplaced, or damaged. This lack of responsibility specifically includes, but is not limited to, wallets, purses, cellular telephones, electronic devices, and keys. 5. I do hereby waive, release and forever discharge to MFit Fitness Center, from any and all responsibilities or liability for any present and future injuries or damages resulting or arising from my participation in any activities including but not limited to exercise, personal training or use of the equipment including any injuries and damages caused by the negligent act or omission of any of those persons or entities mentioned above. 6. Packages and sessions are non-refundable. 7. Packages and sessions must be paid in full and are scheduled at the time of sign-up. 8. If your child has any allergies/medical conditions or disabilities, you need to notify MFit Gym prior to registration. 9. Photo Release: MFit Gym has my permission to use my or my child’s photograph publicly to promote the Fitness Center. I understand that the images may be used in print publications, online publications, presentations, websites, and social media. I also understand that no loyalty, fee, or other compensation shall become payable to me by reason of such use. *
