Huff Hills Ski Area Season Pass Waiver and Release of Liability As a condition of using a Huff Hill Ski Area Season Pass (season pass) and holding a Season Pass identification Card (pass ID) and using the facilities of Huff Hills Ski Area, Inc (ski area), I agree to the following: 1. I understand and accept the fact that Winter Sports, in their various forms, are inherently hazardous and dangerous and have inherent and uncontrollable risks. Winter Sports can include, but are not limited to downhill skiing, telemark skiing, snowboarding, cross country skiing, snow biking, use of adaptive equipment or other devices. I realize that injuries are a common and ordinary occurrence of these activities. I voluntarily assume all inherent risk for personal injury or death or property damage associated with my attendance at and use of Huff Hills Ski Area, inc. facilities and premises. I also understand and accept all terms and conditions of participation listed at lift ticket or season pass purchase points, including but not limited to the skiers responsibility code. I also understand that my sole remedy for not accepting the risks, responsibilities and conditions contained in this document is to not participate in the activities, not sure my season pass or pass ID and leave the premises. I also agree to indemnify the ski area for all costs associated with a legal action resulting from my use of the ski area. 2. My pass ID and my season pass benefits are non-transferrable and may not be used by anyone but myself. If I allow someone else to use my season pass or pass ID, I understand it will become void, and be immediately revoked. 3. I understand that if I am participating in activities that are reckless, destructive, offensive or constitute misconduct, I may have my season pass and/or pass ID revoked. I also understand that it is the ski area’s management and staff’s discretion if a behavior constitutes misconduct, or is reckless, destructive or offensive. 4. My pass ID remains the property of the ski area, and upon request it must be surrendered to any authorized representative of the ski area. 5. I agree to keep my pass ID visible at all times when riding on or loading a passenger tramway or any kind, including chairlifts, handle tows, rope tows or other lifts. I also agree to have my pass ID visible when entering the lift maze or loading area of the lifts. 6. In the event my pass ID is lost, stolen, tampered with, altered or damaged in any way that in the judgement of the ski area is no longer in a usable condition, I agree the ski area may, at their discretion, require me to pay a $35 replacement fee. 7. I also agree that a season pass is a NON-REFUNDABLE purchase. The season pass will not be refunded due to snow conditions, the user’s physical condition, change of residence, or other events beyond the control of the ski area. By signing this document, I am certifying that I have read and agree and accept all terms and conditions contained in this document.
