I, the undersigned, hereby acknowledge that I am voluntarily participating in the beach clean-up event organized by Malibu Sandals, which will take place at date and location communicated.
In consideration for being permitted to participate in this event, I hereby waive, release, and discharge Malibu Sandals, its officers, directors, employees, agents, volunteers, and all other persons or entities acting in any capacity on their behalf (hereinafter referred to as "Releasees"), from any and all claims, liabilities, or demands for personal injury, sickness, or death, as well as property damage and expenses, of any nature whatsoever which may be incurred by me arising out of or in any way connected with my participation in this event.
I understand that this waiver includes any claims, whether caused by negligence, the action or inaction of any of the Releasees, or otherwise.
I further agree to indemnify, defend, and hold harmless the Releasees against any and all claims, liabilities, judgments, costs, expenses (including reasonable attorneys' fees), and damages arising out of or in connection with my participation in this event.
I acknowledge that participating in a beach clean-up event involves certain inherent risks, including but not limited to the risk of injury from tripping, falling, or contact with sharp objects or hazardous materials.
I certify that I am physically fit, have sufficiently prepared or trained for participation in this event, and have not been advised otherwise by a qualified medical professional.
I grant Malibu Sandals the right to take photographs and/or video recordings of me during the event and to use such materials for promotional purposes without compensation to me.
I understand that Malibu Sandals does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance, in the event of injury, illness, death, or property damage.
I understand that Malibu Sandals reserves the right to cancel the event at any time for any reason, and in such cases, Malibu Sandals shall not be liable for any costs, damages, or expenses incurred by participants.
