I understand that I am responsible for my behavior, and I will only perform volunteer work or participate in activities that I am comfortable doing and that I believe I can perform safely. Assumption of Risk: The undersigned Participant hereby acknowledges and attests that they are fully cognizant of the nature of the community service Community Service Event and the risks associated and involved in their voluntary participation in the physical challenges of the Community Service Event. Participant further acknowledges and attests that s/he is qualified, in good health, and in proper physical condition to participate therein and that Participant’s participation in such activities may result in injury, illness, death or damage to Participant’s person or Participant’s personal property. Participant acknowledges that s/he has been advised that the activity may be inherently dangerous, and that Participant is choosing to engage in the activity by his/her own free will and, therefore assume all the risks and liabilities therein. Additionally, Participant acknowledges that such risks and dangers may be caused by, and/or made more serious by Participant, Guests or other participants. Such injury, illness, death or damage to Participant’s person or Participant’s personal property, may arise from foreseeable or unforeseeable causes. Participant voluntarily agrees to assume full responsibility for any risks of loss, damage, and/or personal injury, including death that may be sustained by Participant as well as any loss or damage to Participant’s personal property, as a result of engaging in the activity. The undersigned Participant knowingly and voluntarily, accept, and assume responsibility for, each risk and danger that may arise out of, or occur during, Participant’s participation in the Community Service Event. Release of Liability. The undersigned Participant hereby RELEASE, DISCHARGE, WAIVE, COVENANT NOT TO SUE AND HOLDS HARMLESS Holt Cemetery, any subdivision thereof, its officers, agents, board of directors, owners, members, managers, directors, officers, employees, agents, contractors, subcontractors, assignees, and/or representatives (Released Parties) from and for any and all liability whatsoever that may arise, directly or indirectly, now or in the future, by reasons of any injury damage, loss, or expense incurred in connection with his/her participation in the Community Service Event, including that caused solely or in part by the fault (including, but not limited to, negligence, gross negligence, and/or recklessness) of the Released Parties. This Release and Waiver of Liability shall be binding on Participant’s heirs, executors, administrators, successors and assigns.Indemnification and Hold Harmless. The undersigned Participant hereby agree to INDEMNIFY, DEFEND AND HOLD HARMLESS the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, losses, damages and liabilities including, but not limited to, attorney’s fees, actions or proceedings of every kind and character, which arise directly or indirectly from, or in any way related to, Participant’s actions and participation in the Community Service Event, and the actions and/or participation of Guests, other participants and others while engaged in the activities the Community Service Event. Severability. The undersigned Participant expressly agree that the foregoing assumption of risk, release and waiver of liability and indemnity agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Louisiana and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Acknowledgment of Understanding. The undersigned Participant hereby acknowledges that s/he has carefully read this Agreement in its entirety and has had the opportunity to ask questions about the same. Participant fully understands this Agreement, that s/he is giving up substantial rights in connection therewith, and that the terms herein are contractual, and not a mere recital. Participant acknowledges that s/he is signing this agreement freely and voluntarily as a condition of participation in the Community Service Event.
