BY SUBMITTING THIS FORM ON-LINE, I AM AGREEING TO ALL OF THE BELOW TERMS.

I understand and agree that Partners for Education, Agriculture, and Sustainability (PEAS) and property owners of sites where PEAS programming takes place  (Henceforth "PEAS" & "Property Owners") are not responsible for personal injury or property damage incurred by any volunteer, program or event participant, or farm member, or for theft, loss or destruction of any property owned by a volunteer, program or event participant, or farm member while participating in a PEAS led activity or event.  

I assume full responsibility for conducting myself in a civil manner and agree to not engage in unacceptable conduct, including but not limited to vandalism, consumption of alcoholic beverages on school or District properties, possession and/or use of illegal drugs or weapons of any kind, verbal and/or physical harassment and/or abuse, defamation, and littering while on any school site.

I understand and agree persons involved with PEAS programs shall not discriminate on basis of race, color, national or ethnic origin, religion, marital status, age, sex sexual orientation, disability, in the administration of this program.

In the event that a dispute arises between volunteers, participants, or members and a resolution of the dispute cannot be reached by these individuals, I agree to have the PEAS Board will act as the arbitrator for the dispute and abide by the decision reached.

I voluntarily RELEASE AND DISCHARGE PEAS/ Property Owners , anyone associated with PEAS (specifically including PEAS staff, farm members, and volunteers, Property Owners' employees, agents, representatives, volunteers, heirs, executors, administrators, successors and assigns), PEAS and anyone associated PEAS from any and all personal injury or property damage sustained by me or any child (whose name appears below) while on the participating in PEAS events or programming.  All of the released parties listed above are sometimes collectively referred to in the release as the RELEASED PARTIES.

I assume full responsibility for any risk of injury, damage or accidents that may occur while participating in PEAS events or programming, and I WAIVE any claim, demands or causes of action that I may have or acquire against the RELEASED PARTIES as a result of any activities on the Farm or other approved sites, EVEN IF SUCH CLAIMS ARE BASED ON THE NEGLIGENCE OF THE RELEASED PARTIES.

I agree not to sue the RELEASED PARTIES for any claim arising out of any activity led by PEAS or at PEAS Farm or at a partner event location or school campus. I agree that this release is intended to be as broad and inclusive as is permitted by the laws of the State of Texas, and if any portion of this release is held to be invalid, the balance of the release will continue in full force and effect. This release is effective each time that I enter the Farm after signing this release.

Photographic Release. I grant and convey unto PEAS all right, title, and interest in all photographic images and video or audio recordings made by PEAS during the participation of listed members/volunteers in PEAS programs. These photos or recording may be used to promote PEAS’ programs in the media or highlight work that is taking place on campus, with partner schools or community organizations, funders, grantors, or at the community farm for any purposes PEAS deems necessary.

This release will be construed according to the laws of the State of Texas, and venue for legal action to interpret or enforce this release will be Travis County, Texas.

This release states the full and final agreement between me and the RELEASED PARTIES, and this release may not be modified or altered by any verbal or implied agreements.

I HAVE CAREFULLY READ THIS RELEASE AND I FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A COMPLETE RELEASE OF LIABILITY AND WAIVER OF CLAIMS. I UNDERSTAND THAT I WOULD NOT BE ALLOWED TO PARTICIPATE IN PEAS ACTIVITIES OR EVENTS IF I DO NOT AGREE TO THE TERMS OF THIS RELEASE. I HAVE SIGNED THIS RELEASE OF MY OWN FREE WILL AND AGREE TO ITS TERMS. BY SUBMITTING THIS FORM ON-LINE, I AM AGREEING TO ALL OF THE ABOVE TERMS.
