APPLICATION NO: LUMS20221110001/CN CENTRAL SCHEME. (to develop the northern portion of the Beachwood Golf Course).

As a signatory to this petition, I/we record my/our:

Opposition to the development of Beachwood for any purpose other than golf, recreational open space, and nature conservation;

Concern that the proposed development will commit municipal infrastructure to a development that is not needed or desired by the local community or eThekwini at large, and will compromise the ability of the Municipality to provide for those who are already in need of basic services; 

Access to the golf course as a vital open space and source of recreation and pleasure to the community of Durban North and no matter who owns the land, it is protected as such by a condition in the Title Deed of the Durban North Estates. This condition relates to a servitude in favour of the remainder of the properties that comprised Durban North Estates.  It is unconscionable for the applicant to attempt to rob the community of its right (which cannot be removed) and destroy its place and character for commercial gain; and

Disappointment that the Municipality and its leaders have excluded affected communities from their consultative planning process.  A window period of 30 days for comment on a predetermined application, is wholly inadequate, and a denial of my/our constitutional rights.

In summary we are angry that both our rights and one of the most environmentally renowned ecosystems are under threat by a consortium which simply wants to make profit at our expense. We trust that both the applicant and the city will understand that we will fight this battle all the way to the Constitutional Court if necessary.
