Assumption of Risk and Waiver of Liability

In consideration of being allowed to participate in any skating or related activities with Synchro Stars Synchronized Skating Teams, Inc. the undersigned acknowledges, appreciates and agrees that: I/we am/are aware that figure skating is a dangerous sport, and that my (or my child’s) participation in skating or training activities is at my (or my child’s) sole risk. I KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS ON BEHALF OF MYSELF OR MY CHILD, AND I ASSUME FULL RESPONSIBILITY AND LIABILITY FOR MY OR MY CHILD’S PARTICIPATION. 

I hereby and forever RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Synchro Stars Synchronized Skating Teams, Inc., Conway Arena (Nashua, NH) and each party’s respective directors, agents, officers, shareholders, employees, and volunteers, other participants, and owners and lessors of premises on which the skating activities takes place (the “Releasees”) from any and all liability, lawsuits, claims, actions, administrative proceedings, demands, losses, or damages on my account, including those caused or alleged to be caused in whole or in part by the negligence, fault, breach of warranty, products liability, or strict liability of the Releasees or otherwise, including negligent rescue operations, and I further agree that if, despite this release and waiver of liability, I or anyone on my behalf makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any and all monetary losses including, but not limited to, litigation costs including attorneys’ fees.  This release and waiver of liability includes a release and waiver of liability from any and all such claims which might be made by members of my immediate family or their heirs, executors, administrators, legal representatives, assignees, and successor’s interest.  I intend that this waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
