OUR AGREEMENT BETWEEN THE BIRTH-DATE SALE AND YOU

YOUR PARTICIPATION IN THIS WEBSITE AND ANY OTHER SERVICES PROVIDED BY FINDING BUSI (the "Services") IS SUBJECT TO THE FOLLOWING LEGALLY BINDING TERMS AND CONDITIONS. CAREFULLY READ ALL OF THE FOLLOWING TERMS AND CONDITIONS BEFORE YOU PROCEED. SUBMITTING THIS APPLICATION IS THE EQUIVALENT OF YOUR SIGNATURE AND INDICATES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS AND THAT YOU INTEND TO BE LEGALLY BOUND BY THEM.  

Use at Your Own Risk: The Services and the content on The BirthDate Sale website (the "Site") are provided "as is" and without warranties of any kind either express or implied. By using the Services, you acknowledge and agree that your use of the Services is entirely at your own risk. We make no representation or warranties regarding the Site or content on the Site, including, without limitation, that the Site or content on the Site will be accurate, complete, correct, timely or suitable, that the Site will be available at all times or that the Site will be free from errors, viruses or other harmful components.  

No Recourse: You hereby acknowledge that you, any customers who access the Site ("Customers") and the owners and operators of The BirthDate Sale (the "Providers") are all fully independent contracting parties. Any sales or promotions offered on the Site and accepted by a Customer, are offered for sale and accepted independently from, and to the full exclusion of, the Providers. For greater certainty, the Providers offer an enabling platform to connect you with Customers, only. We are not a party to the relationship between you and Customers, and as such, the Providers have no responsibility to you as regards: (a) and dispute or disagreement between you and Customers regarding the Services or content on the Site; (b) the products and services you sell to Customers; (c) your interaction with any Customer; (d) any transactions you may enter into with any Customer; and (e) collecting payment in respect of such transactions. You agree that you will have no recourse or remedy against the Providers in respect of the foregoing.

Release: You agree to release, remise, acquit and discharge the Providers from any claim, actions, demands, costs and expenses of any kind whatsoever, whether in contract, negligence or tort, at law or in equity, or by statute or otherwise, howsoever caused, with respect to your use of, or the Provider's operation of, the Site and the Services.

Indemnity:  You agree to indemnify, save and hold harmless the Providers, from and against any claims, actions, demands, judgments, awards, declarations, orders, settlements, damages (including general, special, punitive, aggravated or exemplary damages), liabilities, losses, costs, charges, interest and expenses, or proceedings of any kind whatsoever which may be initiated or presented by any Customers or other persons, individuals or other legal entities, and which arise directly or indirectly from your use of or reliance on the Site or the Services or information available on or through the Site or the Services.
As per CASL requirements, your e-mail will be kept confidential but will be used by our business office to contact you about newsletters and promotions. You can unsubscribe at any time but you will still receive  business correspondence in regards to invoices, receipts and other business correspondence.
