WAIVER AND RELEASE OF LIABILITY

This is a binding legal agreement.  As a participant in the programs, activities, and events of Canadian Blind Hockey, the undersigned acknowledges and agrees to the following terms.

 

Disclaimer

 

Canadian Blind Hockey, their directors, officers, members, employees, coaches, volunteers, officials, participants, clubs, agents, sponsors, advertisers, agencies, owners/operators of facilities, and representatives (the “Organization”) are not responsible for any injury, damage or loss of any kind suffered by a participant during, or as a result of, any program, activity or event, caused in any manner whatsoever including, but not limited to, the negligence of the Organization. 

 

Description of Risks and Release of Liability

 

In consideration of being allowed to participate in any way in the Canadian Blind Hockey athletic/sports program, related events, and activities, I hereby acknowledge that I am aware of the risks and hazards associated with or related to hockey and the programs of Canadian Blind Hockey.  The undersigned acknowledges, appreciates, agrees, and is fully aware that:

 

1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

 

2.  The injuries sustained in playing hockey can be severe, and I may come into close contact with other participants including the possibility of accidental and unexpected contact; and,

 

3.  My risk of injury increases as I become fatigued; and,

 

4. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

 

5. I willingly agree to comply with the stated and customary terms and conditions for participation.  If however I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

 

6. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS CANADIAN BLIND HOCKEY, their directors, officers, members, employees, coaches, volunteers, officials, participants, clubs, agents, sponsors, including AMI ACCESSIBLE MEDIA INC. and the CANADIAN NATIONAL INSTITUTE FOR THE BLIND, advertisers, agencies, owners/operators of facilities, and representatives (the “Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

 

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

 

This is to certify that I, as participant, do consent and agree to the release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify the Releasees from any and all liabilities incident to my involvement or participation in these programs as provided above.

MEDIA RELEASE CONSENT FORM

 

NOTE TO ALL PARTICIPANTS. PLEASE READ CAREFULLY BEFORE YOU SIGN.

 

PART 1 – EVENTS

 

I, hereby agree and give my permission for

 

Canadian Blind Hockey and/or partners to record, film, photograph, audiotape, or videotape my name, image, performance (hereinafter collectively referred to as “Works”) and to display, publish, or distribute these Works for the purpose of publishing, posting on the Canadian Blind Hockey website, posting in arenas, posting on social media sites and/or for broadcasting on television or radio as determined by Canadian Blind Hockey to inform others about Canadian Blind Hockey programs. 

 

 Such Works may be published and posted in the following manners including but not limited to the following:

 

·         Canadian Blind Hockey newsletters, brochures, reports, or other publications including the Canadian Blind Hockey website or social media efforts.

·         External media such as newspapers, magazines, television, radio, and/or online publications for events relating to the Canadian Blind Hockey program.

·         Videos, DVDs, or CDs for educational or entertainment purposes.

 

I hereby waive any right to approve the use of these Works now or in the future, whether the use is known to me or unknown, and I waive any right to any royalties related to the use of these Works. 

 

I understand that the Works may appear in electronic form on the internet or in other publications outside of Canadian Blind Hockey’s control.  I agree that I will not hold Canadian Blind Hockey responsible for any harm that may arise from such unauthorized reproduction. 

 

 

PART 2 – MEDIA SPECIFIC

 

I also understand that external media organizations may attend Canadian Blind Hockey events.  I give permission for my name, image, work, and performance to be photographed, filed, audio-taped or videotaped for the purpose of being published and/or broadcast on-line, on television or radio. 

 

I have read this Media Release Consent Form and I fully understand the contents and meaning of this release.  I understand that I am free to contact Canadian Blind Hockey’s principals with any questions regarding this release.

Rowan’s Law: Concussion Awareness Resources

Effective July 1, 2019 the Ontario Government has enacted Rowan’s Law (Concussion Safety), which requires all sports organizations, including Canadian Blind Hockey, to have a Concussion Code of Conduct. Canadian Blind Hockey’s Concussion Code of Conduct is on our website. The Concussion Code of Conduct requires that all participants review the Ontario Government’s issued Concussion Resources on an annual basis. A participant is subject to a Concussion Code of Conduct for each Sports Organization a participant registers with. Review the Concussion Awareness Resources (if you are an athlete, parent, coach, team trainer or official).

I confirm that I have reviewed the Canadian Blind Hockey Concussion Code of Conduct and the Concussion Awareness Resources and commit to operating within the parameters of the Canadian Blind Hockey Concussion Code of Conduct.
