In consideration for my use of the facilities, clubhouse, ranges, land, equipment and amenities (the “Premises”) of Interlake Sporting Association (“ISA”) at 13633 NE 97th Street, Redmond, Washington USA 98033 and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I agree to the terms of this affirmation, release and waiver (“Agreement”):

DANGEROUS ACTIVITIES. I acknowledge that personal or group activities on ISA Premises such as archery, firearm shooting, competitions, hunter education, training courses and being on the Premises (“Shooting Sports”) can be dangerous. I understand these risks cannot be eliminated. I know I risk being shot, injured or killed by shrapnel, explosions, stray bullets or arrows.

HAZARDS ON PREMISES. I understand that ISA Premises have steep and uneven walking surfaces, stairs, paths, ravines, rooftops, target enclosures, fence lines, roads embankments and other structures where I can trip, fall or be struck by falling trees or rocks. I will not exceed my health restrictions while on the Premises. I understand and acknowledge that ISA Premises including the Clubhouse, grounds, ranges and hillsides contain clear and present dangerous conditions. I will conduct myself as a reasonably prudent person refraining from activities on ISA premises that could bring injury, serious injury or even death upon my person or others. I agree that if I am unfit to travel across the Premises, I will only use parts of the Premises that as reasonably prudent person would believe they can safely access.

ASSUMPTION OF RISK. I knowingly, freely and personally assume all risks including bodily injury, disability, death, losses and property damage (“Damages”), foreseen or unforeseen, for myself, my family, legal heirs and assigns (“Heirs”).

RELEASE & WAIVER. I release ISA, its officers, directors, agents, volunteers, contract employees, service providers, and representatives (“Released Parties”) from any Damages arising from the Shooting Sports or any activities including the voluntary consumption of foods and beverages on the Premises (“Activities”)  for myself and my Heirs. I waive all rights and claims for Damages against the Released Parties for my participation in the Shooting Sports, whether or not sponsored, authorized or otherwise permitted by ISA, for myself and my Heirs.  I further release ISA and its Released Parties from any and all claims, defenses, and counterclaims of which I am  aware, such waiver and release being with full knowledge and understanding of the circumstances and effect thereof and after having consulted legal counsel with respect thereto. I affirmatively agree that the waivers contained herein do not violate public policy and are conspicuous and are enforceable against myself and my Heirs.

As a condition of using the Premises, I knowingly waive any and all legal rights to sue ISA and Released Parties in a court of law, small claims court, local/state/federal courts, or any other courts.  I further agree that the decision of the ISA Board of Directors (“Board”) regarding my conduct, access to and use of the Premises is my only avenue of redress and my sole remedy.  I agree that the Board’s decision is final and indisputable.  

I understand where my access to the Premises has been terminated, I am ineligible for future membership at ISA to ensure the safety of all persons and the larger community surrounding ISA. If I do not agree with the terms and conditions of this Agreement, I will not use or enter the Premises and leave immediately. 

INDEMNIFICATION. I further agree to indemnify, defend, and hold harmless ISA and its Released Parties from any claims, defenses, and counterclaims for myself and my Heirs from and against all claims, costs, expenses, attorneys’ fees, settlements and judgments arising from any claims related to my membership, the Shooting Sports, or other Activities at ISA or in its Clubhouse.

RESPONSIBILITY.  I will be responsible for my actions and those of any minors I bring to the Premises. I will reimburse ISA for all losses caused by my personal property (such as motor vehicles, smoking, vaping and pets) to ISA Premises. I am responsible for the operation and proper functioning of any firearms, archery equipment, ammunition, safety glasses, hearing protection and other sporting goods (“Gear”) I use on ISA Premises. ISA and the Released Parties have no responsibility to guarantee, inspect or approve the safety of my Gear.

ADHERENCE TO RULES. I have read, understand and will abide by ISA’s Standard Operating Procedures and all other ISA safety and range rules (“Rules”) whether verbal, written, electronic, posted, or otherwise presented to me or posted on the Premises. I have signed ISA’s Acknowledgement of Safety Rules document. I agree that if I violate the Rules or provide incomplete or inaccurate information on this Agreement or any ISA documents, I may be (1) escorted off the Premises; (2) banned from future use of the Premises; and (3) prohibited from becoming an ISA Member.

 LAWFUL PERSON AFFIRMATIONS. I am not prohibited from purchasing, possessing, accessing, or controlling firearms, weapons or ammunition under any state, federal or foreign law. None of the below statuses apply to me (“Prohibitions”):

• I have not been convicted in any court of a crime punishable by imprisonment for a term exceeding one year;
• I am not a fugitive from justice;
• I am not an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act); 
• I have not been adjudicated mentally defective, incompetent or been committed to any mental institution;
• I am not a non-immigrant alien or illegal alien in the United States (unless a lawful permanent resident of the United States or in possession of  a valid alien firearm license under RCW §9.41.173)(“Non-immigrant alien” is defined as a foreign tourist, student, business traveler, or temporary worker who enters the U.S. for fixed periods of time);
• I have not been dishonorably discharged from the Armed Forces of any country; 
• I have not renounced my U.S. citizenship;
• I am not subject to court order restraining for harassing, stalking, threatening intimate partner/child of an intimate partner; 
• I have not been convicted of a misdemeanor crime of domestic violence.

COMPLIANCE WITH THE LAW. I recognize that ISA and its Released Parties must comply with the law whether municipal, state or federal. I recognize that they would never willingly allow me to participate in the Shooting Sports or use the Premises if they reasonably suspected that I was subjected to the above Prohibitions or was untruthful about my above affirmations. 

MISCELLANEOUS. I am legally competent to enter into this Agreement. This Agreement is binding to the fullest extent of the law. This Agreement will be governed by Washington law. If I am not age 18, a parent and/or guardian must execute this Agreement for me and will identify their relationship below.
