THE MANCHIN-SCHUMER SIDE DEAL IS A BAD DEAL— BAD FOR OUR STATE, OUR COUNTRY AND OUR CLIMATE.
We, the undersigned organizations and concerned citizens of West Virginia, call on the President and Congress to reject the “Permitting Reform Provisions”—the side deal made to secure Senator Manchin’s vote for the recently signed Inflation Reduction Act.
The Manchin-Schumer "dirty energy" deal must not be allowed to sneak through on any fund-the-government or fund-the-military continuing resolution legislation. Reject the deal for what it is: a gift to fossil fuel proponents that would be a disaster for clean air, clean water and vulnerable frontline communities in Appalachia and across the country.
The so-called “permitting reform” deal removes critical environmental protections and speeds up the government review process so that industry can sneak through dangerous projects. It places decisions in the hands of courts in Washington rather than in districts near the people most affected by water and air pollution caused by current and future energy projects, dirty or clean.
We oppose any executive order or legislation that fast-tracks a disastrous and failing project like the Mountain Valley Pipeline (MVP). This 42-inch diameter mega-pipeline trenches 303 miles across steep and unstable terrain to carry highly pressurized methane gas from fracking operations in northwest West Virginia to central Virginia. It is unprecedented in the number of miles it crosses with steep slopes and high landslide risk. A proposed “Southgate extension” would extend the damage into North Carolina.
- From our front row seats in West Virginia, we know that this unsafe, unneeded pipeline deserves to fail based on its own record. MVP chose to build on too steep slopes and unstable soils. It broke the law by cutting corners—underestimating the route’s challenges and overestimating its construction plans. MVP has committed more than 350 environmental violations, incurring fines of over $2.5 million in West Virginia and Virginia. The courts nullified MVP’s permits because the agencies did not follow the laws to protect our land and water.
- If put into service, the MVP will be a disaster waiting to happen for families and communities along the pipeline route. It will condemn our Marcellus and Utica shale communities to decades of expanded fracking and air pollution, and to billions of gallons of water forever contaminated with toxic chemicals.
- If the flawed and failing MVP is granted a free pass into service, it will be a stark warning to communities across the United States. What chance will they have as they too are subjected to the full force and breadth of this side deal and its “provisions” to fast-track future energy projects?
- MVP is not needed to ensure domestic energy security, nor to help our European allies affected by Putin’s war on Ukraine. MVP would not be in service in time, and Europe is rapidly moving to build its own energy independence. (Why depend on us when the mere change of administration could pull "US" out of the NATO alliance once again?)
- Time is running out. We need to radically reduce methane emissions and dependency now. Don’t push a flawed, risky and unneeded pipeline into service—one that will cause the expansion of more new fossil-fuel infrastructure and lock in another generation of climate-killing greenhouse gas emissions.
We urge you: Don’t let the fossil fuel industry keep writing its own ticket. Don’t Undermine the Climate Benefits of the Inflation Reduction Act. Reject the "Dirty Energy" Side Deal! … Stop the Mountain Valley Pipeline!
