Section F. Participation fee, conditions and rules
1. Basic principles:
In considering the applications, the organizers will, in principle observe the following rules:
•
First come, first served.
•
You need to be a member of the EOFed, or an orchestra that is a member of one of the national orchestra associations members of EOFed. A list of members can be found here:

The organizers reserve the right to observe a balanced representation from all EOFed member countries.
•
Individual musicians from EOFed member countries are welcome as well.
2. Participation fee:
a) The participation fee of the festival (for musicians and accompanying persons) is:
•
€ 360 per person in 2-bed rooms,
•
€ 440 per person in single room.
•
€ 290 per youth under 25 in multiple (3 or more) bed rooms
•
€ 40 / 60 / 80 per extra night (for arrival on May 3 and/or departure on May 9, room and breakfast per person in multiple (youth under 25) / 2-bed /single room)
b) The participation fee includes:
•
all concerts
•
all workshops
•
hotel accommodation from May 4 to May 8, 2022 (4 nights)
•
breakfast at the hotel
•
opening and closing ceremonies both with dinner buffet (5 and 7 May)
•
lunch for 5 -7 May 2021
•
local transportation during the festival inside Plovdiv
c) The participation fee does not include:
•
orchestra`s own travel costs to and from Plovdiv (travelling by own bus) or Sofia airport (travelling by plane)
•
dinner on 4 and 6 May and lunch on the day of departure (8 May) (the organizers will help to organize them at your own costs if you should want so).
•
sightseeing
•
insurance
•
instrument rental (where needed)
•
personal costs
d) The festival will be able to provide instruments for hire, instruments that are difficult or expensive to transport. The price for rent of cellos, double basses and bigger percussion instruments (timpani set 26-29, bass drum, xylophone, drum-set) will be announced later.
3. Payment/deposit:
•
As soon as your application/registration is accepted, the organizers will confirm and ask you to pay a deposit of 50% of the full price by January 31, 2022. The banking details will be communicated together with the invoicing.
•
The balance is payable before March 31, 2022.
4. Cancellation clause and refund policy
4.1. Definitions for the purposes of this chapter 4:
a)
“The Festival” is the 12th European Orchestra Festival, hereafter EOF `22, set up by EOFed in the city of Plovdiv, Bulgaria, in 2022.
b)
“The Organizer” is the European Orchestra Federation EOFed, represented by the Board of EOFed.
c)
“Organizers” are the bodies, organisations, companies, and individual persons charged by The Organizer with specific tasks in relation with EOF `22. In specific and defined cases, they are entitled to act for and on behalf of EOFed.
d)
“The participants” are members of EOFed, i.e. orchestras, delegations of orchestras, individual persons who are themselves members of an EOFed member, accompanying persons, invited guest orchestras and groups or ensembles, and individual guest persons.
e)
Deadline dates, e.g. “before February 15”, mean no later than February 14, 23:59 o’clock.
4.2. Cancellation by The Organizer
4.2.1. “Force Majeure Event”
a)
If The Organizer is required to cancel The Festival due to acts beyond its reasonable control including, without limitation, acts of “God”, fire, flood, explosion, earthquake, or other natural forces, war or acts of terrorism, civil unrest, accident, any strike or labour disturbance, pandemic declared by governmental decree, governmental action in general, or any other event similar to those enumerated above (each a "Force Majeure Event"), The Organizer shall not be held liable or responsible to The Participants for any cost or expense nor be deemed to have defaulted under or breached this Contract for failure to execute any of its terms.
b)
If The Festival is affected by a Force Majeure Event, The Organizer shall provide notice thereof to The Participants as soon as reasonably practicable.
4.2.2. Insufficient number of participants
a)
If The Organizer deems the execution of The Festival to be unreasonable or impossible due to budgetary reasons, the budget being based on a given number of registered participants (break-even), The Organizer is entitled to cancel The Festival.
b)
In such case the refund policy as exposed in §4.3.2. here after applies.
4.3. Refund policy
4.3.1. Force Majeure Event according to § 4.2.1. above
a)
In the case a Force Majeure Event occurs before February 15, 2022, 90% of the participation fee or deposit thereof shall be refunded.
b)
In the case a Force Majeure Event occurs before March 30, 2022, 70% of the participation fee or deposit thereof shall be refunded.
c)
In the case a Force Majeure Event occurs between March 31, 2022, and May 4, 2022, there shall be no refund of the participation fee or the deposit thereof.
d)
In the case a refund according to lit a) and b) above is due, The Participants shall be refunded within 10 working days after the date of the notice.
4.3.2. Insufficient number of The Participants according to § 4.2.2. above
a)
Should The Organizer make use of the clause in §4.2.2. above, the relevant decision will be taken by The Organizer before February 1, 2022.
b)
Participants will be informed immediately by way of e-mail and notices on the EOFed, and The Festival home pages
www.eofed.org and
www.orchestrafestival.eu.
c)
In such case 90 % of the deposits paid by The Participants shall be refunded within 10 working days after the publication of the notice according to lit. b) above.
4.4. Cancellation by The Participants and refund policy
Provided neither §4.2.1. or §4.2.2. enter into force, and one or more of The Participants cancel the registration, the following refund rules shall apply:
a)
Cancellation before February 15, 2022: refund of 90% of the participation fee deposit.
b)
Cancellation between February 15, 2022, and before March 31, 2022: 50% refund of the participation fee deposit.
c)
Cancellation after March 31, 2022: no refund.
d)
In case of cancellation by parts of The Participants, the leader of such entity notifies The Organizer, and the rules in a), b) and c) above will apply proportionately.
Registration form is a Contract with all its legal consequences for all the parties involved and applied by Swiss law as EOFed is an organisation regulated by Swiss law.
5. Insurance
•
Illness and accident insurance as well as travel and instrument insurance are the sole responsibility of the participants. The organizers formally decline all liabilities in this respect.
•
Make sure that personal insurance covers travel and stay abroad in the countries you visit on your trip.
6. Protection of data
In principle, we process users’ personal data only insofar as this is necessary for the organization of the festival. The personal data of the individual applicants will be deleted as soon as the purpose of the storage ceases to apply. Storage may also occur if provided for by legal regulations to which the responsible party is subject. Blocking or deletion of the data also occurs when a storage period prescribed by the standards named expires, unless there is a need for further storage of the data for completion of a contract or fulfillment of a contract.
Pictures and video content for the use of EOFed and its festival will be made. EOFed will not use this content for commercial purposes. EOFed will only publicize the content as news items, to further EOFed and its Festivals.
By signing this form you accept the rules and regulations as set out for participation in the 12th European Orchestra Festival EOF`22.
Registration form is a Contract with all its legal consequences for all the parties involved and applied by Swiss law a EOFed is an organisation regulated by Swiss law.
