Exeter Homeowners Association (further known as Exeter HOA herein) has put in place preventative measures to reduce the spread of COVID-19; however, the Exeter HOA cannot guarantee that you or anyone with you who enters any facility and/or recreational areas owned by Exeter HOA will not become infected with COVID-19. Further, attending the Exeter HOA Facility could increase your risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I, and those accompanying me, may be exposed to or infected by COVID-19 by appearing at the Exeter HOA Facility and by using the facility’s that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Exeter HOA, representatives, contractors, agents, suppliers and anyone else who may be at or near the Exeter HOA Facility when I am there.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself and other who accompany me to the Exeter HOA facility (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or those accompanying me may experience or incur in connection with being present at the Exeter HOA facility. On my behalf, and those accompanying me, I hereby release, covenant not to sue, discharge, and hold harmless the Exeter HOA, its employees, representatives, contractors, officers, owners, managers, agents, suppliers, customers and anyone else who may be at or near the Exeter HOA facility when I am there, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims related to a COVID-19 infection, whether such infection occurs before, during, or after appearing at the Exeter HOA Facility.
