Waiver/Release: Read Carefully. This Registration Form includes a release of liability and waiver of legal rights and deprives you of the right to sue the Westside Academy of Dance (“Westside”) and other parties. Do not sign this Registration Form unless you have read and understand it in its entirety.

NOTICE: THIS IS A LEGALLY BINDING AGREEMENT. Each Participant must have a signed Waiver prior to participating in Westside Activities. I have chosen to participate in the Activities provided by Westside. I hereby represent, acknowledge and understand:

That I am making this waiver in consideration of Westside providing me with dance lessons, instruction, studio usage privileges, rehearsals, performances and other related activities (collectively, “Activities”), at Westside’s premises or elsewhere.
The above-named student is in good health and proper physical condition to participate in Activities wherever they may occur. I agree that it is my sole responsibility to determine whether I am sufficiently healthy enough to participate in Activities at any time.
Participating in Activities involves a risk of injury and dangers, which include, without limitation, the potential for serious bodily injury, permanent disability, paralysis, death; loss or damage to property; accidents, illness, contact or collision with others; equipment failure, and other unknown risks and dangers (collectively, “Risks”). These Risks may be caused in whole or in part by my actions or inactions, or the actions or inactions of others. I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses incurred as a result of or in connection with my participation in Activities.
I agree to be familiar with and abide by the rules, policies and procedures of Westside. I accept responsibility for my conduct and actions while participating in Activities, and the condition and adequacy of their equipment, and accept full responsibility for my behavior and any damage I may cause to Westside’s or others’ facilities.
I hereby forever release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless Westside and its officers, directors, owners, employees, agents, representatives, affiliated entities, subsidiaries, parent companies, and contractors (collectively, “Released Parties”) with respect to any liability, claim, demand, cause of action, damage, loss or expense (including court costs and attorneys’ fees) of any kind or nature (collectively, “Liability”) which may arise out of, result from, or relate to my participation in Activities, including claims for Liability caused in whole or in part by the negligence of the Released Parties. I further agree that if despite this waiver, I or anyone on my behalf, makes a claim for Liability against any of the Release Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liability which may be incurred as a result of such claim.
Westside may not carry liability insurance for injuries or loss of property in connection with Activities.
I have read this Waiver / Release carefully, understand its terms and conditions, acknowledge that I am giving up substantial legal rights by signing this Waiver / Release, acknowledge that I have signed this Waiver / Release freely and voluntarily, without inducement, assurance or guarantee, and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Waiver / Release. This Waiver / Release constitutes the complete understanding between the parties regarding these issues and no oral representation, statements or inducements have been made apart from this Waiver / Release. If any provision of this Waiver / Release is held to be unlawful, void, or for any reasons unenforceable, then that provision shall be deemed severable from this Waiver / Release and shall not affect the validity and enforceability of any remaining provisions.
