I acknowledge that the Christmas in Crescent 5k is a test of a person's physical and mental limits and it carries with it potential for death, serious injury, and property loss. I hereby assume the risks of participating in the Christmas in Crescent 5k.Ā
I certify that I am physically fit, have sufficiently trained for participation in this event, and have not been advised otherwise by a qualified health professional.Ā
I herby take the following action for myself, my executors, administrators, heirs, next of kin, successors and assigns, or anyone else who might claim or sue on my behalf, and I expressly acknowledge that it is my intent to take these actions:
1. I agree to abide by the competitive rules adopted by the Christmas in Crescent 5k

2. I agree that prior to participating in an event, I will inspect the racecourse, facilities, equipment, and areas to be used and if I believe any to be unsafe, I will advise the person supervising the event, activity, facility, or area.
3. I waive , release, discharge from any and all claims, losses, or liabilities for death, personal injury, partial or permanent disability, property damage, medical or hospital bills, theft or damages of any kind, including economic losses (and loss) and/or stolen items, which arise out of or relate to my participation in, or my traveling to and from the event, the following persons or entities: the City of Crescent, the Crescent Chamber of Commerce, or the persons of the Christmas in Crescent event committee, employees, event owners, volunteers, all states, cities, or localities in which events or segments of events are held, and the officers, directors, employees, representatives, volunteers, and agents of any of the above even if such claims, losses, or liabilities are caused by the negligent acts or omissions of the persons I am hereby releasing or are caused by the negligent acts of any other person or entity.
4. I acknowledge that there will be traffic on the course route, and I assume the risks of running and participating in this event. I also assume any and all other risks associated with participating in this event including by not limited to falls, contact and/or crashes with other participants, effects of weather including high heat and/or humidity; freezing cold temperatures; traffic and the conditions of the road including surrounding terrain.Ā
5.Ā Ā IĀ acknowledge and ASSUME ALL OF THE RISKS and aspects of participating in the 5k. I acknowledge that running, walking, biking and other portions of this event are inherently dangerous, and I understand that I will be participating in the event at my own risk, that I am responsible for the risk of participation in the event, and that I am waiving and releasing my legal rights to sue for any injury or damages arising out of or resulting from my participation in the event. I further understand that any injury or damages incurred may be the result of negligence, omission, or carelessness by the Released Parties.
6.Ā The parent or legal guardian who signs the Waiver Agreement on behalf of a minor, incapacitated and/or mentally challenged person (hereinafter āSaid Personā), hereby acknowledges that he or she has the legal capacity and authority to act on behalf of Said Person to legally bind Said Person to the Waiver Agreement. The parent or legal guardian who signs the Waiver Agreement agrees to indemnify and hold harmless the Released Parties for any expenses incurred, Claims made, or liabilities assessed against them, as a result of any insufficiency of legal capacity or authority to act on behalf of Said Person in the execution of the Waiver Agreement.Ā
7.Ā I understand that unforeseen obstacles, and dangers, natural or manmade will occur during the event and that I am participating with caution and take full responsibility to take proper action to avoid these unforeseen obstacles and dangers.
8. I grant permission to all of the foregoing to use my photographs, motion pictures, recordings or any other record of this event for any legitimate purposes.Ā Ā
9.Ā
I understand that this event does not provide for refunds in the event of a cancellation, and by signing this waiver, I consent that I am not entitled to a refund if the event is cancelled before or during the event for any reason.Ā
10.Ā If any provision of this Waiver Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Waiver Agreement and shall not affect the validity and enforceability of any remaining provisions.Ā
