I, the undersigned Participant, acknowledge and agree that:

1. NIF Australia reserves the right in its absolute discretion to refuse any Participant’s application, for whatever reason or reasons it deems fit;
2. NIF Australia acts as the organiser of the Program and that travel services including transportation and accommodation are provided by independent contractors and are not agents of NIF Australia (“Suppliers”);
3. This Release and Disclaimer is provided for the benefit of NIF Australia;
4. I grant the indemnities as set out below;
5. Any power, right, release, indemnity or discharge given to NIF Australia in this Release and Disclaimer is also given to NIF Australia’s officers, directors, members, volunteers, employees, contractors, representatives, agents, counsellors, and Suppliers;
6. This Release and Disclaimer applies while I am on the study tour, including its components in Israel, the Palestinian Territories and elsewhere (Program);
7. I have completed all of the Program forms completely and truthfully;
8. I will inform NIF Australia if any of the details that I have provided to NIF Australia become incorrect or misleading at any stage up until the Program’s conclusion;
9. Any illness or ailment (physical or mental) that I may have suffered prior to the commencement of, or occurring or recurring during, the Program, may be due cause for return to the country of origin, and/or treatment in Israel at my own expense without refund;
10. The Program activities may be subject to certain dangers or risks, and I:
(a) Am aware of and understand the dangers and risks associated with the Program;
(b) Am voluntarily participating in the Program; and
(c) Accept any and all dangers or risks associated with participating in the Program;
11. It is a condition of my participating on the Program that I will purchase comprehensive travel insurance which includes cover for cancellation/interruption, medical expenses for injury or illness, medical evacuation, theft of valuables, and baggage damage and that I will provide NIF Australia with a copy of my certificate of insurance 14 days prior to the commencement of the Program;
12. I release and forever discharge, to the extent permitted by law, NIF Australia and Suppliers from any and all causes of action, suits, proceedings, claims, demands and liabilities in any way directly or indirectly arising out of or in connection with my participation in or expulsion from the Program (including those arising out of death, injury, loss of or damage to property or involving financial or any consequential loss), whether or not arising out of or by reason of the negligence, action or inaction or otherwise of any Supplier (Claim), together with any costs, fees and expenses (including legal fees) that may be incurred as a result of any such Claim;
13. I indemnify NIF Australia from and against any Claim suffered or incurred or brought or made against NIF Australia, together with any costs, fees and expenses (including legal fees on an indemnity basis) that may be incurred as a result of any Claim together with any costs, fees and expenses (including legal fees) that may be incurred as a result of any Claim;
14. I will abide by the Program Rules in Schedule 1 of this Release and Disclaimer;
15. If I breach one or more of the Program Rules, NIF Australia has the right to suspend or expel me from the Program at their discretion;
16. If I breach any law or regulation, NIF Australia may notify the relevant authorities of the breach;
17. While I am absent or on leave from the Program, whether the absence or leave is with or without authorisation, NIF Australia:
(a) Are not liable or held responsible for any harm, injury or damage caused by or to me; and
(b) Are released from all liability as a result of anything which occurs during my absence from the Program;
18. I am liable to reimburse NIF Australia for any expenses in connection with my absence or leave from the Program;
19. If I am suspended or expelled from the Program, I am liable to reimburse NIF Australia’s for any expenses they may incur in connection with my suspension or expulsion from the Program, including (but without being limited to):
(a) Any expenses involved with me returning to Australia at NIF Australia’s request; and
(b) All costs involved in funding the Program for me, including (but without being limited to) costs of transportation, meals and activities;
20. If I am suspended, expelled, absent or on leave from the Program, then I will not be eligible for any refund from the NIF Australia at the NIF Australia’s discretion;
21. I voluntarily entered into this Release and Disclaimer, have read and understood all of its terms and the terms of all of the other Program forms (including but without being limited to the Program Rules), and I agree to be bound by all such terms before signing; and
22. this Release and Disclaimer will be binding on me and my executors, administrators, heirs, next of kin, successors and assigns.
