The above-named minor child (hereinafter, “Child”) and I, as Child’s parent or legal guardian, have voluntarily chosen to visit, observe, and/or participate in water-based or land-based rowing, boating, or other activities, including, but not limited to, use of exercise, fitness, and/or athletic training equipment and facilities and related activities, whether competitive or recreational in nature, at or in Hains Park or otherwise at, on, or in close proximity to Rogers Lake in Old Lyme, Connecticut (hereinafter, the “Rowing Activities”). My signature below confirms my understanding and agreement regarding the following:

I hereby acknowledge that visiting, observing, and/or participating in the Rowing Activities involves risks, dangers, and hazards, both known and unknown, including, but not limited to, muscle strains, sprains, and tears, broken bones, burns, cuts, contusions, abrasions, falls, sun exposure, insects and wild animal exposure and bites, insect- and animal-borne illness and disease, dehydration, and drowning, which can result in serious physical or emotional injury, shock, paralysis, temporary or permanent disability, death, damage, and loss to Child, property, or third parties. By signing below, I acknowledge that I have made my own investigation of these risks, dangers, and hazards, understand these risks, dangers, and hazards, and I knowingly, willingly, and voluntarily agree to assume all risk of personal injury, damage, or loss arising during the course of visiting, observing, and/or participating in the Rowing Activities, and acknowledge that the Old Lyme Rowing Association, Regional School District #18 Board of Education, Region #18 Public School District, and the Town of Old Lyme, their directors, officers, board members, commission members, officials, administrators, employees, staff, personnel, volunteers, agents, representatives, organizers, sponsors, and advertisers, and their families and heirs (hereinafter the “Released Parties”) shall not be liable for injury or damage arising therefrom, and that I may not be covered by the Released Parties’ insurance carriers, if any, for same.

I understand that I am advised to consult with a health care provider of my own choosing and at my own cost before signing this Assumption of Risk and General Release and permitting Child to visit, observe, and/or participate in the Rowing Activities, and that by signing, I represent that I understand the nature of the Rowing Activities, whether water-based or land-based, and that I or my Child is qualified, in good health, and in proper physical condition to visit, observe, and/or participate in the Rowing Activities.

I understand that it is advised that Child be covered by a health insurance policy while Child visits, observes, and/or participates in the Rowing Activities, and that regardless of the insured status of Child or myself, under no circumstances will the Released Parties be responsible for any illness, injury, damage, or loss suffered or caused by Child. I further agree that if Child becomes ill, injured, or incapacitated, the Released Parties may take any action they deem necessary for Child’s safety and well-being, including, at my own expense (whether covered by health insurance or otherwise), securing medical treatment, transportation, and/or hospitalization.

I acknowledge that Child is not required to visit, observe, and/or participate in the Rowing Activities by any person.

I understand that while Child is present in Hains Park, that the Town of Old Lyme’s rules and regulations pertaining to Hains Park are applicable to Child’s presence in Hains Park and Child’s visiting, observing, and/or participating in the Rowing Activities there.

Knowing the risks, dangers, and hazards described above, and in recognition of the agreements and understandings set forth above, I agree, on behalf of myself, Child, and on behalf of both my and Child’s family, heirs, and personal representative(s), to assume all the risks and responsibilities surrounding Child’s visiting, observing, and/or participating in the Rowing Activities. Further, to the maximum extent permitted by law, I release, hold harmless, and agree to indemnify the Released Parties from and against any present or future claims, losses, liabilities, costs, and expenses for injury to person or property, or for any other damage, which I or Child may suffer, or for which I or Child may be liable to any other person, related to Child’s visiting, observing, and/or participating in the Rowing Activities resulting from any cause including but not limited to negligence on Child’s part or on the part of any of the Released Parties.

I certify that I am age 18 or older. I have carefully read and freely sign this Assumption of Risk and General Release. I understand and agree that this Assumption of Risk and General Release is a legally binding agreement and that no oral or written statements or representations can or will alter the contents of this document and that no inducements have influenced my or Child’s signing. I agree that this agreement shall be governed by the laws of the State of Connecticut (excluding its conflict of laws principles), which shall be the forum for any lawsuits filed under or incident to this agreement or the Rowing Activities. I further agree that this agreement is intended to be as broad and inclusive as is permissible by the laws of the State of Connecticut and that if any portion of this agreement is held to be invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.
