2022 International Food and Music Festival Vendor Agreement

Date: Saturday, August 13th, 2022, 2pm – 8pm

DISCLAIMER

By signing below this form the Vendor referenced herein has confirmed their presence at the Ivy Hill Neighborhood Association’s 22nd Annual International Food and Music Festival on Saturday, August 13th, 2022 or RAINDATE Sunday, August 14th, 2022. Merchant Vendors will pay a fee of $80.00,  Food Vendors will pay a fee of $80.00 to the Ivy Hill Neighborhood Association no later than Monday, August 1st, 2022. CASH/PAYPAL PAYMENTS ACCEPTED. Vendor will be responsible for supplying their own table for this event unless stated otherwise. In the event the vendor is unable to attend, the fee is NON-REFUNDABLE.

 

FOOD VENDOR WILL:

  • Pay a fee of $100 for the right to be one of 10’ exclusive food trucks at the IHNA festival on Saturday August 13, 2022 at Ivy Hill Park in Newark NJ
  • Provide a quality food product for sale including at least one substantial item at a price point of $5 or less
  • Present a food truck that is clean and staff by professional personnel
  • Provide proof of current certificate of insurance and required food service license and/or certificate. Certificate of insurance must name IHNA as an additionally insured.
  • Follow the rule and guidelines set forth by Essex County Parks and the IHNA as producers of the festival
  • Arrive on time and remain open for the full contracted time or until sold out.

HOLD HARMLESS

Vendor shall fully defend, indemnify, and hold harmless Ivy Hill Neighborhood Association and all of it’s parties from any and all claims, lawsuits, demands, causes of action, liability, loss, damage and/or injury, of any kind whatsoever ( including without limitation all claims for monetary loss, property damage, equitable relief, personal injury and/or wrongful death), whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, in any way whatsoever, any acts, omissions, negligence, or willful misconduct on the part of vendor by harmless Ivy Hill Neighborhood Association and all of it’s parties, its officers, owners, personnel, employees, agents, contractors, invitees, or volunteers. This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgments, awards, decrees, attorneys’ fees, and related costs or expenses, and any reimbursements to vendor by harmless Ivy Hill Neighborhood Association and all of it’s parties, for all legal fees, expenses, and costs incurred by it.

By submitting this application in its entirety and I understand its contents and will comply with all of its Rules and Regulations, and Terms and Conditions of the Ivy Hill Neighborhood Association, the City of Newark, Essex County and all our authorized agents. 1. All personal property of event participants is the sole responsibility of the participant. Ivy Hill Neighborhood Association is not responsible for lost, stolen or damaged property.


2. The use of illegal drugs is prohibited in all venues of The IHNA Annual Music & Food Festival


3. Assume any and all risks of personal injuries to my group and myself. Including but not limited to bills, hospital bills, permanent disability, partial disability, and death and damage to my property, real, or personal, caused by or arising from my participation in the event or activity.


4. Agree to indemnify, defend and hold harmless the City of Newark, Essex County, and Ivy Hill Neighborhood Association, their volunteers, officers, directors and employees of and from any costs, expenses, claims, damages, suits and liability whatsoever arising from the actions or alleged actions of your, your organization or your members.

5. I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that Ivy Hill Neighborhood Association has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that Ivy Hill Neighborhood Association can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, event staff, and other participants and their families.
I voluntarily seek participation in events provided by Ivy Hill Neighborhood Association and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my appointment.
