AGREEMENT OF RELEASE, WAIVER OF LIABILITY AND
ACKNOWLEDGEMENT OF PROPRIETARY INFORMATION

By his/her signature below, the undersigned participant (“Participant”) agrees to the following:

1. Release
Participant acknowledges and accepts the risks inherent in participation in fitness classes offered
by The Right Weigh God’s Way, Inc. (“TRWGW”) and hereby voluntarily assumes the risk of
physical or mental injury, accident, death, loss, cost or damage to his or her person or property
which might arise from such participation. The Participant, his or her heirs, executors,
representatives, or assigns hereby releases TRWGW from all claims or liabilities for personal
injury or property damages of any kind sustained by the Participant while on the premises where
such fitness services are offered. Participant further certifies that he or she is in good health and
is able to undertake and engage in the physical exercise or sports activities in which he or she
chooses to participate.

2. Waiver of Liability
In further consideration of being permitted to participate in TRWGW fitness classes, Participant
knowingly, voluntarily and expressly waives any claim he or she may have against TRWGW for
injury or damages Participant may sustain as a result of such participation.

3. Acknowledgement of Proprietary Information
Participant understands, acknowledges and agrees that the exercises taught by TRWGW were
developed by TRWGW exclusively for use by TRWGW and that TRWGW has proprietary
rights with respect to its exercises, its exercise program and trademarks (the “Proprietary
Information”). Participant agrees that he/she will not record, reduce to writing, copy, reproduce
or disseminate in any manner the Proprietary Information, nor use the Proprietary Information in
any manner for profit or otherwise.

4. Miscellaneous Provisions
a. Severability. If any one or more of the provisions contained in this Agreement is invalid,
illegal or unenforceable in any respect, the validity, legality or enforceability of the remaining
provisions contained in this Agreement will not in any way be affected or impaired.
b. Choice of Law; Forum. This Agreement shall be governed by the laws of the State of
Maryland and any claims arising out of/relating thereto shall be brought in Calvert County
courts.
