We are a group of students and alumni of the University of Oxford and the University of Cambridge. We write jointly to express our deepest concerns at the Hong Kong government’s efforts to push through the proposed amendments to the Fugitive Offenders Ordinance (“FOO”) and the Mutual Legal Assistance in Criminal Matters Ordinance (“MLAO”) (the “Proposed Amendments”).

The Proposed Amendments would have the effect, amongst others, of allowing rendition of fugitive offenders between Mainland China and Hong Kong upon the issuance of a certificate by the Chief Executive of Hong Kong, who is herself appointed by the Central Authorities in Beijing. Anyone in Hong Kong, whether human rights defenders or businessmen who may have offended the Mainland authorities in one way or another, could be renditioned to Mainland China, where the criminal justice system guarantees neither fair trial nor other basic human rights.

Rendition of fugitive offenders and mutual legal assistance in criminal matters between Mainland China and Hong Kong have been at a longstanding impasse for more than 20 years since the handover. We strenuously oppose the Proposed Amendments and especially the haste at which the government now seeks to introduce measures of such immense significance after only 20 days of consultation.

As the Hong Kong Bar Association and many others have pointed out, the Proposed Amendments present a genuine threat to the human rights of people in Hong Kong, and the government’s arguments for the proposed amendments rest on shaky grounds. Tens of thousands of people in Hong Kong have taken to the streets to oppose the Proposed Amendments. The international community (including chambers of commerce) has also expressed their utmost concern at the serious detrimental effects of these Proposed Amendments on the rule of law, human rights and autonomy of Hong Kong, as well as its continued viability as an international financial and business centre. We are dismayed at the Hong Kong government’s inexplicably dismissive attitude towards such widespread and well-justified concern.

As students and alumni of the University of Oxford and the University of Cambridge, we hold the pursuit of truth as one of our highest ideals. Even putting aside the merits or demerits of the proposed amendments, the haste at which and the attitude with which the government is pushing through the Proposed Amendments render it simply impossible for the Hong Kong society to have an informed and engaged dialogue on the important issues that they raise.

In view of the above, we call upon the Hong Kong government to immediately withdraw the proposed amendments to the FOO and the MLAO. The rule of law in Hong Kong and the human rights of the people in Hong Kong should not be jeopardised in these circumstances.
