Indemnification and Hold Harmless:
The Sponsoring Group agrees to protect, defend, indemnify, and hold harmless San Juan Island Park and
Recreation District and San Juan County, its appointed and elected officers and employees, from and against all liability, loss and expense, including attorney’s fees and costs, by reason of any and all claims and demands upon San Juan Island Park and Recreation District and San Juan County, its appointed and elected officers and employees, for damages or injuries (including death) sustained by any person or persons arising out of or in consequence of the Sponsoring Group performance of services associated with this contract or by conditions created thereby, and the defense of any such claim or actions. A Sponsoring group with live animals in its activity or a Sponsoring group serving any type of food agrees to have in effect a General Liability policy with a minimal liability limit of $1,000,000 per occurrence and
will name San Juan Island Park and Recreation District as an additional insured on their General Liability
policy, and will provide the district proof.
Waiver:
The waiver of, or the failure to take action with respect to the breach of any term, covenant or condition of this contract shall not be deemed to be a waiver of such term, covenant or condition on any subsequent breach. All remedies afforded in this contract shall be taken as cumulative, in addition to every other remedy provided by law.
Severability:
It is understood and agreed by the parties that if any term or provision of this contract is determined by the courts to be illegal or in conflict with any law of the state of Washington or of the United States, the validity of the remaining portions shall not be affected, and the rights and obligations of the parties shall be construed and enforced as if the contract did not contain the particular term or provision held to be invalid.

Coronavirus, COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. Federal and state authorities recommend social distancing as a mean to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Participating in SJI Parks and Recreation programs could increase the risk of contracting COVID-19. SJI Parks and Recreation District in no way warrants that COVID-19 infection will not occur through participation in SJI Parks and Recreation District programs.
Instrument As Entire Agreement:
This instrument contains the entire agreement between the parties and no statements made by any party not
contained in this contract shall be valid or binding. This contract may not be modified except in writing and signed by both parties.
Qualifications:
I certify that the people representing the sponsoring group are adequately trained to perform and provide the duties of the above named activity. I am unaware of any physical, emotional, or mental condition that will affect our participation in the activity.
