WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

1. In consideration to participate in the Pickleball Organized India Trip (“Trip”) from January 17th, 2024 until January 31st, 2024, I hereby forever release and waive my right to bring suit against Pickleball Organized LLC and its owners, managers, agents, contractors, coaches, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 or any other illness related to my participation in Pickleball Organized LLC Trip. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. I further understand, that this release discharges Pickleball Organized LLC from any liability or claim that I, people I am legally responsible for, my heirs, or any personal representatives may have against the Pickleball Organized LLC with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Pickleball Organized LLC. This liability waiver and release extends to the Pickleball Organized LLC together with all owners, partners, and employees.

2. I am fully aware of risks and hazards connected with being on the premises and participating in the Trip, and I am fully aware that there may be risks and hazards unknown to me connected with being on the premises and participating in the Trip, and I hereby elect to voluntarily participate in the Trip, to enter upon the above named premises and engage in activities knowing that conditions may be hazardous, or may become hazardous or dangerous to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of my being a participant in the Trip, whether caused by the negligence of releasees or otherwise.

3. I further hereby agree to indemnify and save and hold harmless the releasees and each of them, from any loss, liability, damage or costs they may incur due to my participation in the Trip, whether caused by the negligence of any or all of the releasees, or otherwise.

4. It is my express intent that this Release shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a Release, Waiver, Discharge and Covenant Not to Sue the above named releasees. In signing this release, I acknowledge and represent that:

A. I have read the foregoing release, understand it, and sign it voluntarily as my own free act and deed;

B. No oral representation, statements or inducements, apart from the foregoing written agreement, have been made;

C. I am at least eighteen (18) years of age and fully competent; and

D. I execute this Release for full, adequate and complete consideration fully intending to be bound by the same.

TRIP CANCELLATION DUE TO FORCE MAJEURE

I understand that Pickleball Organized LLC’s ability to host each pickleball trip shall be subject to force majeure, including but not limited to acts of God, fire, flood, natural disaster, war or threat of war, acts or threats of terrorism, civil disorder, unauthorized strikes, governmental regulation or advisory, recognized health threats as determined by the World Health Organization, the Centers for Disease Control, or local government authority or health agencies (including but not limited to the health threats of COVID-19, H1N1, or similar infectious diseases), curtailment of transportation facilities, or other similar occurrence beyond the control of the parties, where any of those factors, circumstances, situations, or conditions or similar ones prevent the trip from taking place. For any one or more of the reasons above, the pickleball trip may be canceled by the organizers, without liability, damages, fees, or penalty, and any unused deposits or amounts paid shall be credited, as per the cancellation policy.

I further acknowledge that if I begin experiencing symptoms of Covid-19 or any illness before departure or during the trip and have to cancel my Pickleball Organized LLC trip that I will not be refunded.
