1. The Contestant represents and warranties that all application materials are a direct and honest representation of their person. The Contestant represents and warranties that all images contained in the promotional video are of The Contestant, or are otherwise images of other persons not designed to represent The Contestant. All information included in the entry form represents honest and true responses,answered to the best of The Contestant’s knowledge.

2. The Contestant understands that all decisions relating to The Contest and the determination of the winner are to be the sole decision of Level 1 Productions, and their independent consultants. All decisions are final and not open to debate or dispute by The Contestant, or any of their relations, associates, partners, or other parties.

3. The Contestant warrants that they have read in detail all of the official rules, and fully understand and recognize all rules and regulations pertaining to The Contest.

4. The Contestant hereby grants to Level 1 Productions, Inc., the irrevocable non-exclusive right but not the obligation, to distribute, promote, publicize, reproduce and otherwise exploit the footage and/or materials (promotional video and application) as such may be used throughout the universe in perpetuity in all television, broadcast, and digital media. The Contestant hereby grants to Level 1 Productions, Inc., the irrevocable, unrestricted and non-exclusive right to incorporate the footage and/or application in the promotion, publicity, advertising and merchandising of the The Contest, any and all future Level 1 productions, and any related or unrelated television shows or broadcasts. Level 1 Productions, Inc. however, shall not have the obligation to incorporate the footage and/or application in future productions.

5. The Contestant represents and warrants that they have the right to grant the rights granted hereunder and that they own all right, title, and interest, in and to the footage and other application materials including, without limitation, the copyright in and to the footage and/or materials. Level 1 Productions, Inc. shall have no obligation to any third party with respect to use of the footage and/or materials in the application. The Contestant agrees to defend, indemnify and hold Level 1 Productions, Inc. harmless from and against any and all claims, losses, liabilities, damages and expenses including, without limitation, all costs and reasonable attorneys' fees which may result from any breach of The Contestant’s representations and warranties herein.

6. The Contestant assumes all risks and dangers associated with application to The Contest, including any and all risks associated with shooting, creation, or production of content for the promotional video. The Contestant accepts complete responsibility for their own personal mental and physical wellbeing, as well as the mental and physical wellbeing of any additional parties involved in shooting, creation, or production of content for the promotional video, or any further aspects of the application process.

7. Level 1 Productions, Inc., and all of its subsidiaries, affiliates, and partners are to be held harmless and are in no way responsible for damages or claims made by any party in relation to their personal or intellectual property, physical health, image, or likeness, as it relates to The Contest. Nor shall Level 1 Productions, Inc., and any of its subsidiaries, affiliates, and partners be held liable in court of law for any damages associated with participation or entry in The Contest. This includes possible or potential damages incurred in the creation of promotional videos for entry in The Contest, any and all activities pertaining to entry in The Contest, and any activities that may occur as a result of victory or loss of The Contest.

8. This Agreement contains the entire understanding relating to the subject matter contained herein and cannot be modified or terminated except by an agreement signed by both parties. This Agreement shall be binding on all parties, their heirs, successors, and assigns.

9. Level 1 Productions, Inc. reserves the right to make changes, additions, or addendum to the rules, regulations, and prizing as they see fit at any point.

10. This Agreement shall be interpreted in accordance with the laws of The United States, and the undersigned party hereby submits to the exclusive jurisdiction of the Court and Legal System of The United States.
