RENTAL TERMS
1. Valley Wind & Reed (Valley) leases the instrument to the Lessee from month to month at the monthly rental set out above.
2. Rental payments shall be made two months in advance,
3. The first two months rental are non-refundable,
4. The Lessee may terminate this agreement at any time by returning the instrument to Valley.
5. If any rental payment is in arrears for 30 days, Valley may terminate this agreement.
6. On termination of this agreement by Valley or by the Lessee, all rental arrears and cost of uninsured damage repair, if required by Valley, will be paid by the Lessee immediately.
7. The Lessee may not assign this agreement.
8. Title to the instrument will remain in Valley; except that ownership shall pass to the Lessee when rental payments are made equal to the Value set out above.
9. The Lessee is absolutely responsible for the theft, destruction of and damage to the instrument unless Valley insurance applies, and for loss.
10. Instruments will be serviced free except for willful damage or neglect. Valley will NOT reimburse Lessee for repairs performed by a third party, except by prior agreement with Valley.
11. The Lessee shall be responsible for freight to and from Valley, of a returned instrument, whether returned on termination of the rental, or for repair, or otherwise.
12. If the Lessee has paid up to date the monthly premium for Valley insurance, Valley will repair the instrument if it is accidentally damaged. Valley shall in its sole discretion determine whether the instrument is economically repairable. In case of theft, the Lessee shall deliver to Valley a true copy of the police report filed by Lessee. In case of theft or destruction, the Lessee shall deliver to Valley a statutory declaration by the Lessee as to the circumstances of theft or destruction satisfactory to Valley, and the remains of the destroyed instrument if available. A Deductible of $100.00, except saxophones, bass clarinets, oboes, and french horns which are $200.00, shall be borne by the Lessee which absolves the Lessee from any economic liability based on the terms of the contract. Loss of the instrument is not covered.
