This Agreement is made and entered into as of the agreement date by and between you and California Tamil Academy (“CTA”).

In consideration of the mutual covenants and promises of the parties hereto, Volunteer and CTA agree as follows:

1.Volunteer Status and Acceptance.

Volunteer Status. CTA is a 501(c)(3) nonprofit corporation organized to teach the Tamil language and values to children of all age groups. Volunteer acknowledges and agrees that he or she (1) freely and voluntarily offers to perform services for CTA in connection with CTA’s nonprofit activities, without fee, charge or compensation or expectation of compensation beyond reimbursement for pre-approved expenses, (2) will perform tasks at the direction of CTA and CTA staff, and (3) such participation will not, to his or her knowledge, violate or infringe rights or obligations of Volunteer to third parties. Volunteer must be officially accepted and enrolled by CTA prior to performance of any task. Volunteer shall not be considered an employee of CTA.Acceptance. Subject to and conditioned on Volunteer’s execution and acceptance of this Agreement and continued adherence to these terms, CTA accepts and enrolls Volunteer for CTA activities.

2. Purpose of Volunteer Policies.These policies are written to provide overall guidance and direction to Volunteers engaged in volunteer involvement. These policies do not constitute, either implicitly or explicitly, a binding contractual personnel agreement. CTA reserves the exclusive right to change any of these policies at any time and to expect adherence to the changed policy.

3. Assignment of Works and IP Rights. All work product, including without limitation works of authorship, created during or in the course of Volunteer’s service to CTA (the “Work”) and all intellectual property rights thereto, including without limitation copyrights, patent rights, and trademark rights, shall be owned by CTA. The undersigned Volunteer hereby assigns to CTA all right, title, and interest in:

the Volunteer’s Work and contribution to any such Work (“Contribution”) and all intellectual property rights thereto, including copyrights, patent rights, and trademark rights;any registrations and applications for patents, copyrights or trademarks, along with any renewals and extensions thereof, relating to the Contribution or the Work;all works based upon derived from, or incorporating the Contribution or the Work;all income, royalties, damages, claims and payments now or hereafter due or payable with respect to the Contribution or the Work;all causes of action either in law or in equity, for past, present, or future infringement related to the Contribution or the Work, and all rights corresponding to any of the foregoing throughout the world.

In addition, to the extent any law or treaty prohibits the transfer or assignment of any moral rights or rights of restraint the Volunteer has in the Contribution or the Work, Volunteer waives those rights as to CTA, its successors, licensees and assigns.

4. Consideration.This Agreement is made in consideration of and is a condition of the volunteer opportunity offered by CTA.

5. Service at the Discretion of CTA. CTA accepts the service of Volunteers with the understanding that such service is at the sole discretion of CTA. Volunteer agrees that CTA may at any time, for what ever reason, decide to terminate Volunteer’s relationship with CTA.

6. Confidentiality. Volunteer is responsible for maintaining the confidentiality of all proprietary or privileged information to which the Volunteer is exposed while serving as a Volunteer whether the information involves a single staff, volunteer, client or other person or involves overall CTA business. Failure to maintain confidentiality may result in termination of Volunteer’s relationship with CTA or other corrective actions.

7. General Provisions. This Agreement sets forth in full all of the representations, warranties, covenants, and agreements of the parties with respect to the subject matter hereof. No other agreements, covenants, representations, or warranties, express or implied, oral or written, have been made by any party to any other party with respect to the subject matter of this Agreement. All prior and contemporaneous conversations, negotiations, possible and alleged agreements and representations, covenants, and warranties with respect to the subject matter hereof are waived, merged herein, and superseded. This Agreement may not be modified or amended, nor may any rights hereunder be waived, except in a writing signed by the parties hereto. This Agreement is being entered into in, and shall be governed by the laws of, the State of California without regard to its choice of law provisions. Each of the parties consents and agrees that venue in any action arising under or in connection with this Agreement shall be in Alameda County, California. Volunteer shall not assign, sell, transfer, delegate or otherwise dispose of, whether voluntarily or involuntarily, by operation of law or otherwise, this Agreement or any of its rights or obligations under this Agreement without the prior written consent of CTA. Any notices in connection with this Agreement shall be by confirmed email delivery, or delivery by overnight courier (i.e., Fed Ex, UPS, or U.S. Express Mail) to the addresses set forth for each party below.

In Witness Whereof, the undersigned have executed this Agreement as of the date first set forth above.

I understand that a student volunteering opportunity is a privilege and not a right

I understand that there is no financial remuneration for this volunteering opportunity. 

I understand that all volunteering opportunities are entirely subjective and discretionary and can be termed any time. 

I will understand and follow the instructions provided by TCTP MN. 

I will honor and commit my time to the assigned tasks and fulfill them to the best capacity and ability. 

If I need clarity for any of the assigned tasks to follow the instructions, will seek guidance from management team (and/or) assigned members of TCTP MN 

I will not use the TCTP MN as a forum to solicit any commercial or financial services from the students, families (and/or) teachers and members. 

I will not share any personal information of Students, Teachers, Parents or members of TCTP MN to external agencies or organizations

TCTP MN reserves the right on the decision of volunteer opportunity and their decision is final When serving as a volunteer will comply with local state laws and regulations. I will not be under the influence of illegal drugs or alcohol.
